Server Performance & Capacity Clause Samples
The Server Performance & Capacity clause sets standards and requirements for the operational efficiency and resource handling capabilities of a server. It typically outlines minimum performance benchmarks, such as response times, uptime percentages, and the ability to handle a specified number of concurrent users or data loads. By establishing these criteria, the clause ensures that the server can reliably support the needs of its users and prevents service disruptions due to inadequate capacity or poor performance.
Server Performance & Capacity. 3.1. CentralSquare shall provide sufficient server capacity for the duration of this hosting Agreement to meet the reasonable performance requirements for the number of concurrent system users provided for in this Agreement. If the Customer requests, at some later date, to add additional Solutions, increase user licenses, increase storage or processing requirements, and/or request additional environments, these requests will be evaluated and if additional resources are required to support modifications, additional fees may apply.
3.2. “In-network” is defined as any point between which the data packet enters the CentralSquare environment and subsequently departs the CentralSquare environment. Any point of communications outside of the CentralSquare protected network environment shall be deemed as “out-of-network.” CentralSquare is not responsible for Internet connectivity and/or performance out-of-network.
Server Performance & Capacity. The standard provisioning of storage for the cloud solutions is 1 terabyte. If Customer requests to add additional Software, increase storage or processing requirements, and/or request additional environments, these requests will be evaluated and if additional resources are required to support modifications, additional fees may apply at per unit (gigabyte, hour, license, etc).

Origin shall provide sufficient server capacity for the duration of this Agreement to meet the reasonable performance requirements for the number of concurrent system users provided for herein. In the event that Service Availability remains below 99.5% for any three (3) months in a rolling twelve (12) month period, Origin shall immediately increase Service Availability by whatever means are necessary at no additional expense to Customer, to meet or exceed the performance requirements of this Agreement.
