Common use of Shift Lengths Clause in Contracts

Shift Lengths. Shift lengths may consist of eight, nine, ten or twelve 17 hours. The Medical Center reserves the right to create positions consisting of eight, 18 nine, ten or twelve hours, which shall be subject to the established posting criteria set 19 forth in Article 13. The 10 Association shall be notified in writing of the available shifts, applicants, and final 11 appointments for each such shifts when it is granted. 13 8.4.4 In the event the Medical Center proposes any one of the following 14 changes in a unit shift length mix which: 15 1. initiates a new shift length, 17 2. eliminates a shift length, or 19 3. significantly changes the shift length mix 21 The Medical Center shall not proceed with the aforementioned changes 22 without prior consultation with and consent of the Association, and such consent 23 shall not be arbitrarily or capriciously withheld. 25 The Labor Management Committee shall collaboratively develop a work 26 force analysis to inform the committee of the needs and wants of the workforce 27 as it relates to shift lengths. 29 8.4.5 A change in workday duration under this section will not be deemed 30 to have resulted in a vacancy, provided that the change falls within the language 31 of Article 13.6. Discontinuance of a newly established shift length shall be by mutual 28 consent only, except that if a nurse scheduled without in a complementary 29 manner to one or more nurses vacates his or her schedule and the written consent 1 30 schedule is not readily filled, discontinuance of the affected nurse, which complementary 31 scheduled shifts may be rescinded upon written notice initiated by the Employer at least ten 2 twenty (20) 32 days in advance of the posting of the next work schedule. 4 8.4.3 Whenever the initiation of a nine-. The 10 Association shall be notified in writing of the available shifts, applicants, and final 11 appointments for each such shifts when it is granted. 13 8.4.4 In the event the Medical Center proposes any one Employer contemplates discontinuance of several 34 newly established shift lengths or the following 14 changes in remainder of such shifts within a unit shift length mix which: 15 1. initiates a new shift length, 17 2. eliminates a shift length1 department or unit, or 19 3. significantly changes the shift length mix 21 The Medical Center Employer shall not proceed notify and meet with the aforementioned changes 22 without prior consultation with and consent of the 2 Association, upon request, to bargain regarding such contemplated 3 action. Notice shall be provided in accordance with article 14.3. The 4 notice shall specify the number of positions affected and such consent 23 how they will 5 be affected. The Employer shall consider any alternatives the 6 Association may present during bargaining. 8 b. The Employer shall also have the right to establish new positions of 9 ten (10) or twelve (12) hours. 11 c.
