If the member needs a companion along, transportation is provided to the companion free of charge 3.3 SPC 107.60 / 107.61 – Transportation – Specialized Transportation, other (car, van, taxi, bus, or lift/ramp equipped vehicle) that is used to transport a member to a medical service that meets a long-term care outcome. Members eligible for this service must have decision-making authority over a budget for the purchase of such services and cannot be duplicated under another category of service. 3.4 Members must be given the opportunity to direct some or all of their specialized transportation whenever possible to the extent of their ability and desire. Inclusa teams must determine the member’s ability and/or desire to direct services by assessment and by observation and address this in the member’s plan. 3.4 Prior to authorizing payment to family members, the following conditions must be met: 1) The service is authorized by the Inclusa team; 2) The member’s preference is for the family member to provide the service; 3) The Inclusa team monitors and manages any conflict of interest situation that may occur as a result of the family member providing services. 4) The family member meets the MCO’s standards for its subcontractors or employeesproviding the same service; and 5) The family member will either: • Provide an amount of service that exceeds normal family care giving responsibilities for a person in a similar family relationship who does not have a disability; or • Find it necessary to forego paid employment in order to provide the service and is not receiving a pension (including Social Security retirement benefits).

  • Musculoskeletal Injury Prevention and Control (a) The Hospital in consultation with the Joint Health and Safety Committee (JHSC) shall develop, establish and put into effect, musculoskeletal prevention and control measures, procedures, practices and training for the health and safety of employees.

  • DUŠEVNÍ VLASTNICTVÍ The Institution and the Investigator acknowledge and agree that the Sponsor shall have exclusive ownership rights to all Study Data, improvements, developments, discoveries, inventions, work, know-how and other rights (whether or not patentable), created, developed, and/or reduced to practice as a result of or in connection with the conduct of the Study and/or the use of the Study Drug or the Confidential Information, together with all intellectual property rights relating thereto (“Intellectual Property”). The Institution and the Investigator shall promptly disclose in writing to PSI and the Sponsor all Intellectual Property made by the Institution, the Investigator and/or the Study Personnel. The Institution and the Investigator hereby assign all rights, titles and interests in and to any such Intellectual Property to the Sponsor without additional compensation and hereby agree to, during and after the term of this Agreement provide reasonable assistance to obtain patents, including causing the execution of any invention assignment or other documents. Neither Institution nor Investigator shall engage in any activities that require the use of third- party facilities or third-party intellectual property in performing the Study, without Sponsor’s prior written consent. Zdravotnické zařízení a Hlavní zkoušející uznávají a souhlasí, že Zadavatel bude mít výhradní vlastnická práva ke všem Studijním údajům, vylepšením, na vývoj, k objevům, vynálezům, dílům, know-how a dalším právům (ať už patentovatelným či nikoli), vytvořeným, vyvinutým, a/nebo uvedeným do praxe v důsledku nebo v souvislosti s prováděním Studie, a/nebo používáním Studijního léku nebo Důvěrných informací společně s právy duševního vlastnictví s nimi souvisejícími (dále jen „Duševní vlastnictví“). Zdravotnické zařízení a Hlavní zkoušející budou neprodleně písemně informovat PSI a Zadavatele o veškerém Duševním vlastnictví vytvořeném Zdravotnickým zařízením, Hlavním zkoušejícím a/nebo Studijním personálem. Zdravotnické zařízení a Hlavní zkoušející tímto převádějí veškerá práva a zájmy týkající se Duševního vlastnictví na Zadavatele bez další odměny a tímto souhlasí s tím, že během účinnosti a po vypršení této Smlouvy poskytnou přiměřenou součinnost k získání patentu včetně zajištění podpisu dokumentů k převodu objevu nebo jiných dokumentů. Ani Zdravotnické zařízení ani Hlavní zkoušející se v rámci provádění Studie bez předchozího písemného souhlasu Zadavatele nebudou angažovat v žádných aktivitách, které vyžadují použití zařízení nebo duševního vlastnictví třetích stran.

  • SBC-12STATE 47.1.1 The terms contained in this Agreement and any Appendices, Attachments, Exhibits, Schedules, and Addenda constitute the entire agreement between the Parties with respect to the subject matter hereof, superseding all prior understandings, proposals and other communications, oral or written between the Parties during the negotiations of this Agreement and through the execution and/or Effective Date of this Agreement. This Agreement shall not operate as or constitute a novation of any agreement or contract between the Parties that predates the execution and/or Effective Date of this Agreement.

  • Vlastnictví Zdravotnické zařízení si ponechá a bude uchovávat Zdravotní záznamy. Zdravotnické zařízení a Zkoušející převedou na Zadavatele veškerá svá práva, nároky a tituly, včetně práv duševního vlastnictví k Důvěrným informacím (ve smyslu níže uvedeném) a k jakýmkoli jiným Studijním datům a údajům.
