SPECIMEN AND HISTORIC TREE PRESERVATION. (a). The master plan for landscape development must preserve and protect the existing specimen and historic trees on the site to the greatest extent possible. Two specific trees that are required to be preserved are Tree No. 1568 and No. 1493. Preservation of species, such as Live oak and sand live oak trees are preferred over laurel oak trees. Any laurel oak tree considered to be declining, diseased or hazardous is recommended to be removed. (b). The minimum specimen tree protection requirement as noted in Section 11.03.02, Table 11-1 of the Land Development Code shall be met and demonstrated by survey and calculations on the conceptual landscape plans, submitted at the time of Conceptual Master Development Plan. Any trees counted as preserved used to meet this requirement must not be a tree identified by the developers certified arborist as recommended for removal. Also, trees shown as preserved, including those on vacant outparcels, must be provided adequate root protection from development activities and proposed infrastructure as mutually agreed upon by the developers certified arborist and the City’s certified arborist. Preservation of any specimen trees used as credit towards the minimum number of trees may require the shifting of lot lines, entrance roads or other mechanisms to protect specimen trees. If any existing specimen trees in good condition can be successfully relocated on site using all necessary arboricultural practices, they will be allowed to count as a preserved specimen tree. If such trees do not survive within a two-year period, they will be required to be replaced with the total diameter inches of the tree, (minimum replacement tree size of 6 inch caliper). (c). Should any historic trees be found on the site, such trees shall be preserved and incorporated into the overall site plan design. (d). Prior to construction, all specimen and historic trees to remain shall have tree barricades installed at the tree protection zone if possible. Construction materials for this fencing shall be galvanized chain-link fencing attached to galvanized fence posts. Height of fence shall be 4 foot minimum and 6 foot maximum with posts installed 8 foot on center. Signage is required on the fencing (minimum two signs per barricade) in English and Spanish stating, “Do not remove this tree barricade without prior authorization from the City of Palm Coast”.

SPECIMEN AND HISTORIC TREE PRESERVATION. (a). Based on a comprehensive tree survey and professional opinions rendered by International Society of Arboriculture, (ISA) Certified Arborist (Certified Arborist) , the tree preservation and mitigation for the Project shall be controlled by the Tree Preservation Plan attached here to as Exhibit 5. Two specific trees that are required to be preserved are Tree No. 1568 and No. 1493 as identified in the Tree Preservation Plan. During construction activities, a Certified Arborist shall be on-site to supervise all root pruning activities required for construction in the Tree Protection Zone (TPZ) for preserved trees. In addition, the City’s Certified Arborist shall be notified before root pruning activities take place.

  • Historic Preservation Subrecipient agrees to comply with the Historic Preservation requirements set forth in the National Historic Preservation Act of 1966, as amended (16 U.S.C. 470) and the procedures set forth in 36 CFR 800, Protection of Historic Properties, insofar as they apply to the performance of this Contract. In general, this requires concurrence from the State Historic Preservation Officer for all rehabilitation and demolition of historic properties that are fifty years old or older or that are included on a Federal, State, or local historic property list.

  • Media preservation and protection When a Contractor discovers a cyber incident has occurred, the Contractor shall preserve and protect images of all known affected information systems identified in paragraph (c)(1)(i) of this clause and all relevant monitoring/packet capture data for at least 90 days from the submission of the cyber incident report to allow DoD to request the media or decline interest.

  • Procurement of the Site 10.3.1 Pursuant to the notice specified in Clause 4.1.2, the Authority Representative and the Concessionaire shall, on a mutually agreed date and time, inspect the Site and prepare a memorandum containing an inventory of the Site including the vacant and unencumbered land, buildings, structures, road works, trees and any other immovable property on or attached to the Site. Such memorandum shall have appended thereto an appendix (the “Appendix”) specifying in reasonable detail those parts of the Site to which vacant access and Right of Way has not been granted to the Concessionaire. Signing of the memorandum, in two counterparts (each of which shall constitute an original), by the authorised representatives of the Parties shall, subject to the provisions of Clause 10.2.2, be deemed to constitute a valid licence and Right of Way to the Concessionaire for free and unrestricted use and development of the vacant and unencumbered Site during the Concession Period under and in accordance with the provisions of this Agreement and for no other purpose whatsoever. For the avoidance of doubt, it is agreed that valid licence and Right of Way with respect to the parts of the Site as set forth in the Appendix shall be deemed to have been granted to the Concessionaire upon vacant access thereto being provided by the Authority to the Concessionaire.

  • PRESERVATION OF CONTRACTING INFORMATION 2.27.1 The requirements of Subchapter J, Chapter 552, Texas Government Code, may apply to this Agreement and the Contractor agrees that this Agreement can be terminated if the Contractor knowingly or intentionally fails to comply with a requirement of that subchapter. If the requirements of Subchapter J, Chapter 552, Texas Government Code, apply to this Agreement, then for the duration of this Agreement (including the initial term, any renewal terms, and any extensions), Contractor shall preserve all Contracting Information, as defined by Section 552.003 of the Texas Government Code, related to this Agreement as provided by the records retention requirements applicable to the City pursuant to federal or state law or regulation, city ordinance or city policy, which record retention requirements include but are not limited to those set forth in Chapters 201 and 205 of the Texas Local Government Code and Texas Administrative Code Title 13, Chapter 7. Within five business days after receiving a request from the Director, Contractor shall provide any Contracting Information related to this Agreement that is in the custody or possession of Contractor. Upon the expiration or termination of this Agreement, Contractor shall, at the Director’s election, either (a) provide, at no cost to the City, all Contracting Information related to this Agreement that is in the custody or possession of Contractor, or (b) preserve the Contracting Information related to this Agreement as provided by the records retention requirements applicable to the City pursuant to federal or state law or regulation, city ordinance or City policy.

  • Safeguarding and Protecting Children and Vulnerable Adults The Supplier will comply with all applicable legislation and codes of practice, including, where applicable, all legislation and statutory guidance relevant to the safeguarding and protection of children and vulnerable adults and with the British Council’s Child Protection Policy, as notified to the Supplier and amended from time to time, which the Supplier acknowledges may include submitting to a check by the UK Disclosure & Barring Service (DBS) or the equivalent local service; in addition, the Supplier will ensure that, where it engages any other party to supply any of the Services under this Agreement, that that party will also comply with the same requirements as if they were a party to this Agreement.

  • SAFEGUARDING CHILDREN AND VULNERABLE ADULTS 8.1 The Service Provider will have ultimate responsibility for the management and control of any Regulated Activity provided under this agreement and for the purposes of the Safeguarding Vulnerable Groups Xxx 0000.

  • WORK PRESERVATION For the purpose of preserving work and job opportunities for the employees covered by this Agreement, the signatory Employer agrees that no operation, work or services of the kind, nature or type covered by, or presently performed by, or hereafter assigned to, the collective bargaining unit by the signatory Employer will be subcontracted, transferred, leased, diverted, assigned or conveyed in full or in part (hereinafter referred to as “divert” or “subcontract”), by the Employer to any other plant, business, person, or non-unit employees, or to any other mode of operation, unless specifically provided and permitted in this Agreement. In addition, the signatory Employer agrees that it will not, as hereinafter set forth, subcontract or divert the work presently performed by, or hereafter assigned to, its employees to non-employee owner-operators or other business entities owned and/or controlled by the signatory Employer, or its parent, subsidiaries or affiliates.

  • Preservation, Maintenance, and Protection of the Property Inspections. Borrower will not destroy, damage, or impair the Property, allow the Property to deteriorate, or commit waste on the Property. Whether or not Borrower is residing in the Property, Borrower must maintain the Property in order to prevent the Property from deteriorating or decreasing in value due to its condition. Unless Lender determines pursuant to Section 5 that repair or restoration is not economically feasible, Borrower will promptly repair the Property if damaged to avoid further deterioration or damage. If insurance or condemnation proceeds are paid to Lender in connection with damage to, or the taking of, the Property, Borrower will be responsible for repairing or restoring the Property only if Xxxxxx has released proceeds for such purposes. Lender may disburse proceeds for the repairs and restoration in a single payment or in a series of progress payments as the work is completed, depending on the size of the repair or restoration, the terms of the repair agreement, and whether Borrower is in Default on the Loan. Lender may make such disbursements directly to Borrower, to the person repairing or restoring the Property, or payable jointly to both. If the insurance or condemnation proceeds are not sufficient to repair or restore the Property, Borrower remains obligated to complete such repair or restoration. Lender may make reasonable entries upon and inspections of the Property. If Lender has reasonable cause, Xxxxxx may inspect the interior of the improvements on the Property. Lender will give Borrower notice at the time of or prior to such an interior inspection specifying such reasonable cause.

  • Monitoring and Management Information C10.1 The Contractor shall comply with the monitoring arrangements set out in the Monitoring Schedule including, but not limited to, providing such data and information as the Contractor may be required to produce under the Contract.
