Step 4: Optional Mediation. 1. If the grievance remains unresolved after Step 3 Advanced Grievance procedure, and a decision has been issued by the Executive Director, either party may request the opportunity to resolve the matter through mediation. Such request must be made in writing within thirty (30) calendar days of the delivery of the final decision at Step 3, Advanced Grievance. The other party shall have fourteen (14) calendar days to respond to such request. If the parties mutually agree to engage in mediation, the time limits for submitting the grievance to arbitration shall be temporarily suspended while the parties attempt to resolve the matter through mediation.

  • Optional Mediation The Parties may mutually agree to non-binding mediation:

  • Mandatory Mediation Prior to and as a condition of either Party’s filing suit in state or federal court, the Parties shall engage in a mediated settlement conference in accordance with the North Carolina Superior Court Rules Implementing Statewide Mediation. The Parties shall mediate in good faith until settlement is reached or an impasse is declared by the mediator.

  • Mediation Service The Mediation Service is a free and independent service available through MBIE. This service helps to resolve employment relationship problems and generally to promote the smooth conduct of employment relationships. Mediation is a mutual problem solving process, with the aim of reaching an agreement, assisted by an independent third party. If the parties can’t reach a settlement they can ask the mediator, in writing, to make a final and binding decision. A settlement reached through mediation and signed by the mediator at the request of the parties is final, binding and enforceable.
