Student suspension by teacher. 21.3.1 A teacher may suspend any pupil from his or her class for the remainder of the day of the suspension and the day following the suspension for disruption of school activities or willful denial of the valid authority of teachers or other school personnel. The teacher shall be entitled to receive, prior to or upon return of the pupil to the classroom, an oral or written report describing the corrective action(s) taken, if any. 21.3.2 The teacher may also suspend pupil(s) who: 21.3.2.1 caused, attempted to cause, or threatened to cause physical injury to another person; or 21.3.2.2 possessed, sold, or otherwise furnished any firearm, knife, explosive, or other dangerous object, unless, in the case of possession of any such object, the pupil had obtained written permission from a certificated school employee, which was concurred in by the principal or the designee of the principal; or 21.3.2.3 unlawfully possessed, used, sold or otherwise furnished, or was under the influence of any controlled substance, as defined in Section 11007 of the Health and Safety Code, alcoholic beverage, or intoxicant of any kind; or 21.3.2.4 unlawfully offered or arranged or negotiated to sell any controlled substance, as defined in Section 11007 of the Health and Safety Code, alcoholic beverage, or intoxicant of any kind, and then sold, delivered or otherwise furnished to any person another liquid, substance or material in lieu of the controlled substance, alcoholic beverage, or intoxicant; or 21.3.2.5 committed robbery or extortion; or 21.3.2.6 caused or attempted to cause damage to school property or private property; or 21.3.2.7 stole or attempted to steal school property or private property; or

The teacher shall be entitled to receive, prior to or upon return of the pupil to the classroom, an oral or written report describing the corrective action(s) taken, if any. 21.3.2 Any student who is suspended from class shall receive a reentry conference. The reentry conference shall take place as soon as possible, but in no case more than three (3) school days after the reentry date. At the reentry conference, staff, student, and guardian(s)/parent(s) will address the cause of the suspension and determine if additional supports are necessary. 21.3.3 The teacher may also suspend pupil(s) who: 21.3.3.1 caused, attempted to cause, or threatened to cause physical injury to another person; or 21.3.3.2 possessed, sold, or otherwise furnished any firearm, knife, explosive, or other dangerous object, unless, in the case of possession of any such object, the pupil had obtained written permission from a certificated school employee, which was concurred in by the principal or the designee of the principal; or 21.3.3.3 unlawfully possessed, used, sold or otherwise furnished, or was under the influence of any controlled substance, as defined in Section 11007 of the Health and Safety Code, alcoholic beverage, or intoxicant of any kind; or 21.3.3.4 unlawfully offered or arranged or negotiated to sell any controlled substance, as defined in Section 11007 of the Health and Safety Code, alcoholic beverage, or intoxicant of any kind, and then sold, delivered or otherwise furnished to any person another liquid, substance or material in lieu of the controlled substance, alcoholic beverage, or intoxicant; or 21.3.3.5 committed robbery or extortion; or 21.3.3.6 caused or attempted to cause damage to school property or private property; or 21.3.3.7 stole or attempted to steal school property or private property; or
Student suspension by teacher. 1. The District honors and respects the role of teachers as it relates to the discipline of students and to the control of the classroom environment. Teachers shall be granted the rights and responsibilities included in Education Code Section 48900 et. Seq. with respect to the suspension of a student from class. 2. The teacher shall have the right to suspend a student from his/her class for the duration of the day of the infraction and the following day only for those infractions enumerated in Education Code Section 48900 (and in accordance with all its mandated provisions). The teacher, in accordance with Section 48900, shall immediately inform the principal of the student’s suspension from class and will refer the student to him/her. Furthermore, the suspending teacher(s) shall contact the parent(s) as soon as possible and will schedule a parent/teacher conference regarding the suspension. The attendance at the conference of a school administrator will be extended to the parent or guardian.
