Teacher Safety. 15.1 Employees shall not be required to work under unsafe or hazardous conditions or to perform tasks which endanger their health, safety, or well being. Employees shall not be required to intercede in altercations at school related public events under circumstances that would be likely to cause serious risk of bodily harm. 15.2 An employee may use reasonable force as is necessary to protect himself/herself from attack, to protect another person or property, to quell a disturbance threatening physical injury to others, or to obtain possession of weapons or other dangerous objects upon the person or within control of a pupil. 15.3 Employees shall immediately report cases of assault suffered by them in connection with their employment to their principal or other immediate superior and to local law enforcement agencies. Such notification shall be immediately forwarded to the Superintendent who shall report it to law enforcement and who shall comply with any reasonable request from the employee for information in the possession of the Superintendent relating to the incident or the persons involved, and shall act in appropriate ways as liaison between the employee, the police, and the courts. 15.4 If criminal or civil proceedings are brought against an employee alleging that he/she committed an assault in connection with his/her employment, such employee may request the district to furnish legal counsel to defend him/her in any civil action or proceeding brought against him/her, within the limits set by law.

Teacher Safety. Unit members will report to the principal conditions that are unsafe for unit members. The site administrator will respond to the unit member as soon as practicable regarding the unsafe condition. If the unit member does not receive a response within a reasonable period of time, the unit member may then notify the site administrator in writing of the unsafe condition. The site administrator will provide a written response within two workdays.
Teacher Safety. 13.1 When a student receives a disciplinary referral from a teacher, the teacher shall so inform his/her immediate administrator or designee, and upon his/her request attempt to contact the parent or guardian. The administrator or designee shall meet with the student to remedy the problem. This will be done prior to the student's return to the classroom. 13.2 A teacher may suspend a student from his/her classroom in accordance with California Education Code section 48910, for the day of the act(s) giving rise to the suspension and for the day following. Reasons for the suspension may be any of those set forth in California Education Code section 48900. Examples shall include: 13.2.1 Damaging or attempting to damage school property; 13.2.2 Stealing or attempting to steal school property; 13.2.3 Damaging or attempting to damage private property; 13.2.4 Stealing or attempting to steal private property; 13.2.5 Causing, attempting to cause, or threatening to cause physical injury to another person except in self-defense; 13.2.6 Possessing, selling, or otherwise furnishing any firearm, knife, explosive, or other dangerous object of no reasonable use to the pupil at school, or at a school activity off school grounds; 13.2.7 Unlawfully possessing, using, selling, or otherwise furnishing or being under the influence of any controlled substance, as defined in section 11007 of the Health and Safety Code, alcoholic beverage, or intoxicant of any kind; 13.2.8 Possessing or using tobacco on school premises; 13.2.9 Committing an obscene act or engaging in habitual profanity or vulgarity; 13.2.10 Disrupting school activities or otherwise willfully defying the valid authority of the teacher. 13.3 The teacher shall immediately report the suspension to the principal and send the student to the principal for appropriate action. The teacher shall, as soon as practicable, attempt contact with the parent or guardian of the pupil and request a parent-teacher conference regarding the suspension. 13.4 A written description of the rights and duties of all administrators and teachers with respect to student discipline and the rights of suspended students shall be presented to each teacher on the first day of the established work year. 13.5 When, in the judgment of a teacher, a student's behavior represents a danger to the safety of the teacher and/or others and requires the attention of the principal, vice-principal, counselor, psychologist, physician or other specialist, he/she shal...

He/she shall report the suspension to his/her principal and send the student to the principal for appropriate action. 16.4 Good cause is defined as assault or battery upon school personnel or any threat of force of violence directed toward school personnel at any time or place and shall constitute a basis for suspension or expulsion from school; however, no pupil shall be suspended or expelled unless the conduct for which he/she is to be disciplined is related to school activity or school attendance. 16.5 If criminal or civil proceedings are brought against the teacher alleging that he/she committed an assault in connection with his/her employment, such teacher will be entitled to be reimbursed for reasonable counsel fees incurred by him in his/her own defense up to a maximum of $1,000, provided such teacher prevails in subsequent court proceedings or the charges are withdrawn. 16.6 Teacher shall immediately report cases of assault suffered in connection with their employment to their principal or other immediate supervisor, who shall immediately report the incident to the police. 16.6.1 Such notification shall be immediately forwarded to the Superintendent, who shall act in appropriate ways as liaison between all parties involved. 16.7 The Board shall carry an aggregate total of $5,000,000 of liability insurance, which shall cover teachers against personal liability for damage, death or an injury to a person, or damage or loss of property caused by the negligence of the teacher acting within the scope of his/her employment. 16.8 As used in this article, “within the scope of his/her employment”, shall include any voluntary activities, which have been given specific approval by the prin...
Teacher Safety. 13.1 A written description of the duties of all administrators and teachers with respect to student discipline, and rights of suspended students, shall be available to each teacher in a Board Policy Manual located at each school site. 13.2 When, in the judgment of a teacher, a student requires the attention of the principal, assistant principal, counselor, psychologist, nurse, or other specialist, he/she shall so inform his/her principal or immediate superior. The principal or immediate superior shall take appropriate action to remedy the situation and shall arrange as soon as possible for a conference between himself/herself, the teacher, and an appropriate specialist to discuss the problem and to take appropriate steps for its resolution. 13.3 Action shall not be taken against a teacher who uses reasonable force in the performance of his/her duties unless the proper steps have been taken to insure all rights of the teacher granted in Education Code and Board Policy. The Board shall, upon employee request, refer the matter to applicable legal authority for advice and shall provide the teacher with such advice and shall aid financially as covered by school insurance except where the teacher exceeds the course and scope of employment or commits an intentional tort. (See Ed. Code Sec. 35203.) 13.4 The administration shall, upon teacher recommendation, institute action to investigate and process a charge of filthy or vicious habits; if sufficient cause be found, said matter will be presented to the Board for decision. 13.5 A teacher may suspend any pupil from his/her class for the day and the day following for good cause. He/she shall report the suspension and the reason for suspension to his/her principal; and send the student to the principal for appropriate action. “Good cause” is limited to the offenses enumerated in Section 48900 of the Education Code.

Unit members shall not be asked to perform tasks which endanger their health, safety, nor the health and safety of others. 7.2 When a unit member becomes aware of a potential or actual unsafe, hazardous, or unsanitary condition, including the potentially or actually dangerous behavior of people, he or she shall notify either the Principal or Superintendent. If the situation is currently or imminently dangerous, the unit member may take action immediately to insure his or her safety before notifying the Superintendent or Principal. 7.3 If possible, the Principal or Superintendent will act to correct the situation referred to in paragraph 7.2 above. 7.4 If corrective action is delayed or if corrective action is not taken, the Principal, Vice Principal or Superintendent shall state to the unit member in writing, the reasons for the delay or failure to take action. This written statement shall be given to the unit member within three (3) working days of notification of such conditions to the Principal, Vice Principal or Superintendent. 7.4.1 If delay of corrective action would result in the health or safety of unit members and/or students being jeopardized, the Administration shall take all necessary steps to remove unit members and/or students from endangerment immediately. 7.5 The Board shall give full legal defense to any unit member who suffers an assault while in the performance of his or her duties, so long as the performance of the duties is in accordance with accepted District practice. 7.6 When absence arises out of or from such assault, the unit member may request the Board to grant relief from any loss of sick leave or personal leave. 7.7 The Board shall maintain in effect an insurance policy which provides reimbursement to unit members for any loss, damage, or destruction of personal property suffered as a result of/or while performing services for the Board. Coverage limits, and reimbursement procedures, shall be equal to, or greater than, those in effect at the end of the 1986-1987 school year.

When absence arises out of or from such assault or injury, the teacher shall not forfeit any sick leave or personal leave. 11.3 Teachers shall immediately report cases of assault suffered by them in connection with their employment to their Superintendent or his designated representative, who shall immediately report the incident to legal authorities. The Superintendent shall act as liaison between the teacher, the police and the courts. 11.4 If criminal or civil proceedings are brought against a teacher alleging that he/she committed an assault in connection with his/her duties, such teacher may request the District to furnish legal counsel to defend him/her in such proceedings. If the District does not provide such counsel, and the teacher prevails in the proceedings, then the District shall reimburse the teacher for counsel fees incurred by his/her defense, and shall reimburse the teacher for any loss of salary.
