SUB-CONTRACTOR OBLIGATIONS. 3.1 The Sub-contractor shall observe and perform its obligations under the terms of any Call Off Contract it enters into via the Everything FM Framework.
SUB-CONTRACTOR OBLIGATIONS. The Sub-Contractor shall carry out and complete the Sub-Contract Works in accordance with this Agreement and any reasonable instructions of the Contractor. If the Sub-Contract Works include obligations to design and construct (“the Sub-Contractor’s Design Portion”) the Contractor has provided documents showing and describing or otherwise stating the requirements of the Contractor for the design and construction of the Sub-Contractor’s Design Portion (“Contractor’s Requirements”). In response to the Contractor’s Requirements the Sub-Contractor has supplied its proposals (“Sub-Contract Proposals”) which, subject to the terms and conditions of the Sub-Contract, the Sub-Contractor confirms meet the Contractor’s Requirements. The Sub-Contractor shall complete any design of its works in compliance with the CDM Regulations 2015 and in accordance with such other directions as the Contractor may give for the integration of the design for the Sub-Contractor’s Designed Portion with the design for the Main Contract Works as a whole. To the extent that any intellectual property relating to any Sub-Contractor’s Design Portion is vested in the Sub-Contractor then the Sub-Contractor shall grant all necessary licences to the Contractor in accordance with the requirements of the Main Contract. The Sub-Contractor agrees and acknowledges that it is not entitled to exclusive possession of the Site and may be required to work in the same areas as other contractors (whether employed by the Contractor or any other person), and to share any facilities or attendances made available by the Contractor. No claims from the Sub-Contractor in respect of such matters shall be made. The Sub-Contractor is responsible for coordinating his works with that of other trades at all times. The Sub-Contractor is not guaranteed continuous, uninterrupted, or unhindered working and will be required to work in conjunction with and alongside other trades. The Sub-Contractor is deemed to have visited the Site and made himself fully aware of all site conditions. The Sub-Contractor accepts the sole responsibility for, and assumes the risk of, all increased costs, loss and/or expense arising out the physical conditions and characteristics of the Site and its surroundings encountered while carrying out the Sub-Contract Works. SUB-CONTRACTOR OBLIGATIONS. 2.1 The Sub-Contractor confirms that he is self-employed running his own business and agrees that he has no authority to bind the Company in any way and shall not represent that any such authority exists.
