Common use of Successor Plans and Carriers Clause in Contracts

Successor Plans and Carriers. In the event that any of the current benefit plans become unavailable, the County agrees to provide to affected employees a substitute plan for the same service delivery type, if available, at substantially the same or better benefit levels. If a plan or carrier is discontinued and no substitute plan is available of the same service delivery type, the employee will be offered the option to enroll in an alternative service delivery plan. If the County chooses to change from a plan or carrier which is still available, the County agrees that the overall existing level of benefits for each plan will be duplicated as closely as possible but will not be reduced.
