Successor Products. Notwithstanding anything to the contrary, once the rights, licenses and immunities granted under Circuit Patents to an Acquired Party and its Subsidiaries hereunder have been limited pursuant to this Section 9.3.3, in no event shall such rights, licenses and immunities be subsequently broadened or expanded to cover additional products or Patents.

Successor Products. A successor product to a Maintained Software product is not included as a Maintenance benefit. If a successor product to a COBOL, CORBA, or Enterprise product is made available for purchase, Licensee may purchase the license at a price of 60% off of the then-current applicable list price for the successor product if the purchase is made during the Maintenance term of the original Maintained Software. Except where otherwise stated in the applicable end user license agreement or other written agreement between Micro Focus and Licensee, if for a specific license, Licensee purchases a license to a successor product as described in this paragraph, Licensee shall have 90 days from the purchase date to simultaneously use the original and successor product license. At the end of this transition period the license and Maintenance for that license will shift to the successor product and that license will become the Maintained Software. At that time any further use of the original license is not permitted. Notwithstanding the foregoing, there shall be no transition period for those products listed at xxxxx://xxx.xxxxxxxxxx.xxx/support-and- services/mla-product-exclusions and Licensee may not have any such product and the successor product concurrently installed.

Successor Products. The Price of Successor Products (if any) shall be determined at the time the Parties agree to include the supply of such Successor Products under the terms of the Supply Agreement. Successor Products. If the Contractor makes successor products available for the Contractor’s product lines (“New Software”) that includes substantially similar functionality and features as a Program for which an State has purchased a Program License (“Old Software”), the Contractor will provide the State with a migration path from the Old Software to the New Software and the right to use the New Software under this Agreement at no additional charge, provided that (i) the State is current on Technical Support for the Old Software; (ii) this right shall only apply to New Software that is available in production release status on the operating system identified by the State at the time of the request; and (iii) the Contractor is currently making available, such migration path from the Old Software to the New Software to all of its other supported customers without additional charge. If the Contractor does not provide to all of its supported customers a migration path from the Old Software to the New Software free of additional charge, then the Contractor will provide the State with the right to use only the functionality and features contained in the New Software that is substantially similar to the functionality and features contained in the Old Software. The State shall not have the right to use nor shall it use any additional functionality or features in such New Software. All use of New Software shall otherwise be subject to this Agreement. The Parties acknowledge that the Contractor offers Lifetime Support for many of its Products; if Lifetime Support is offered for a Product, such Product is not deemed to be discontinued under the meaning of this section.
Successor Products. The Parties understand that in the event of any termination or expiration of this Agreement, or any discontinuance of the AOL Classifieds, AOL may continue to provide an AOL classifieds product with similar functionalities to the AOL Classifieds. Nothing hereunder shall be construed to prevent AOL from using the look and feel and/or user interface which is part of the AOL Classifieds in any future AOL classifieds offering and providing for the same or similar functionalities for such future offering as is present in the AOL Classifieds, provided such offering does not otherwise violate InfoSpace's intellectual property rights hereunder.
Successor Products. If Licensee is receiving Premium Support Services or Maintenance Services hereunder [ *237 ], then Licensee will be entitled to license such functionality it previously licensed [ *238 ] excluding third-party software. If such separate product contains additional functionality, Licensee may license such functionality at a fee to be mutually agreed, not to exceed SAP’s then current SAP list price.
