Supervision of Contractor. Landlord and Tenant shall jointly supervise the construction of the Improvements by Contractor. Landlord and Tenant shall mutually cooperate with each other in all phases of such supervision in order for the Improvements to be completed in a timely manner in accordance with the Approved Working Drawings. Notwithstanding such joint supervision, Tenant shall pay a construction supervision and management fee (the “Landlord Supervision Fee”) to Landlord in an amount equal to the product of (A) one percent (1%), and (B) the hard costs incurred with the Improvement Allowance Items identified in Sections 2.2.1.3 – 2.2.1.5 (whether paid for via the Improvement Allowance or as an Over-Allowance Amount, which Landlord Supervision Fee shall be for services relating to the coordination of the construction of the Improvements.

Supervision of Contractor. As soon after the acceptance of the tender as the Engineer-in-charge may direct, the contractor shall depute a competent Engineer of his staff to take charge of the work and get it done under his supervision.
Supervision of Contractor. Project Manager shall require Contractors and Design Professionals to perform and cause to be performed the construction required for the Project, including, but not limited to, off-site work, diligently and in a good and workmanlike manner in conformity with the Construction Contracts and Project Development Plan and in accordance with first-class building practice and applicable laws, ordinances, rules, regulations, reservations and other restrictions affecting the site of the Project and the Project;
Supervision of Contractor. Owner has entered into this Contract to delegate the day-to-day management of the Project to Contractor as an independent contractor, subject to the review of Owner and the provisions contained within this Contract. (a) Contractor shall promptly respond to all notices, requests, or inquiries from Owner and will permit Owner to review Contractor's performance of the Services. Owner, however, shall not have the right to exercise control over Project Manager's day-to-day actions in providing Services under this Contract. For purposes of this Section 2.5, Contractor shall be entitled to treat Xxxxx Xxxxxxx and Xxxxxxxx Xxxxxxx, or such other Person as Owner provides notice of in writing from time to time, as the authorized representative of Owner. (b) Except as otherwise provided herein, Contractor shall not be obligated to perform the Services or any other or additional act for, or on behalf of, Owner requiring it to incur, directly or indirectly, any cost or expense not paid for, or reimbursed by Owner. (c) Contractor shall perform the Services and carry out its responsibilities under this Contract as an independent contractor in accordance with Section 2.5. Any contractual relationship between Contractor, Owner and any Personnel shall not: (i) Affect Contractor's status or relationship to Owner as an independent contractor; (ii) Impose a higher standard of care than established herein; or (iii) Create any duty, obligation, or liability for Contractor to perform, act, or assume responsibilities in addition to the Services. (d) Contractor shall not be responsible for any duties or obligations other than those specifically set forth in this Contract, and all such duties and obligations not delegated to Contractor in this Contract shall be retained by Owner.
Supervision of Contractor. The Committee is deemed to be the direct supervisor of the Contractor.
