SUPERVISION OF WORKS. The Engineer shall perform the duties and authority of the Engineer as specified in or necessarily implied from the Contract as well as administer the Contract, dealing with situations in accordance with the contract, taking due regard of all relevant circumstances; the Engineer shall perform his duties or act: • proactively, where the initiative lies with the Engineer in administering the Contract; • reactively, in response to the Contractor’s or the Employer’s requests; and • passively, in observing the requirements of the Contract Wherever appropriate and not in conflict with the Contract, the Engineer shall exercise every reasonable care to protect the interests of the Employer, including safety and environmental considerations. The Engineer shall have the following reporting obligations during supervision of the Works.

SUPERVISION OF WORKS. Following satisfaction of the requirements in clause 6.1, the Grantee shall complete the Grantee's Works in accordance with the plans approved by KiwiRail pursuant to clause 6.1(b) at the Grantee's sole cost in accordance with the provisions of clause 6.2 (where relevant) and to the entire satisfaction of KiwiRail. KiwiRail shall be entitled to require that completion of the Grantee's Works shall either in whole or part be supervised by KiwiRail's appointed railway personnel in which case, the costs of such supervision shall be paid by the Grantee.
SUPERVISION OF WORKS. 16.1 All works under or in course of execution or executed in pursuance of the Agreement shall, at all times be open to the inspection and supervision of the Empowered Committee or its authorised representatives, the Operator shall, at all times during the usual working hours, and all other times for which reasonable notice of the intimation of the Empowered Committee or its authorised representatives to visit the works shall have been given to the Operator, either himself be present to receive orders and instructions or have a responsible agent duly accredited in writing present, for that purpose. Orders given to the Operator's duly authorized agent shall be considered to have the same force and effect as if they had been given to the Operator himself.

  • PROTECTION OF WORK 12.1 Subcontractor shall effectually secure and protect the work done hereunder and assume full responsibility for the condition thereof until final acceptance by the OWNER and Contractor. Subcontractor further agrees to provide such protection as is necessary to protect the work and the workmen of Contractor, the OWNER, and other subcontractors from its operations. 12.2 Subcontractor shall be liable for any loss or damage to any work in place or to any equipment and materials on the job site caused by Subcontractor or its agents, employees or guests.

  • Statement of Work The Statement of Work to which Grantee is bound is incorporated into and made a part of this Grant Agreement for all purposes and included as Attachment A.

  • Technical Services Party B will provide technical services and training to Party A, taking advantage of Party B’s advanced network, website and multimedia technologies to improve Party A’s system integration. Such technical services shall include: (a) administering, managing and maintaining Party A’s information application system and website system infrastructure; (b) providing system optimization plans and implementing optimization features; (c) assuring the security and reliability of the website application systems; (d) procuring, installing and supporting the relevant products produced by Party B, and providing training in the use of those products; (e) managing and maintaining all network and providing technologies to assure the reliability and efficiency thereof; (f) providing information technology services and assuring the reliable operation of the information infrastructure.

  • Scope of Works (a) Users with an appropriate licence type may be able to create and access Scope of Works. (b) The parties acknowledge and agree that: (i) any wording contained in a Scope of Works is established by the Customer, is customisable and within the Customer's absolute control; (ii) Users make decisions within ProcurePro on how to draft Scope of Works and ProcurePro is not responsible for those decisions; (iii) the Supplier is not liable for the Customer's use or reliance upon any Scope of Works; and (iv) the Supplier is not responsible for controlling the use, copying, modification or export of a Scope of Works by any User to which the Customer allows access to that Scope of Works.
