TAXES AND TARIFFS. Any taxes, tariffs and duties whether existing or new on the Concentrate or contained metals or on commercial documents relating thereto or on the cargo itself, imposed in the country of origin shall be borne by the Seller. Any taxes, tariffs and duties whether existing or new on the Concentrate or contained metals or on commercial documents relating thereto or on the cargo itself, imposed in the country of discharge and/or the importing country shall be borne by Buyer.
TAXES AND TARIFFS. All charges stated in any Service Agreement or any invoice are exclusive of taxes or tariffs and the Customer agrees to pay such taxes and tariffs based upon or charged in connection with the Services or the Customer’s use of the Services.

(a) Licensee shall pay any and all taxes (other than taxes on Licensor's net income), tariffs, import and export duties or other fees imposed or assessed in connection with the transactions contemplated by this Agreement, including the delivery of Licensed Products and Documentation to Licensee and the shipment of Licensed Products from Licensee to a Redistributor or Customer.
(b) in the event that Licensee is required by law to withhold any form of tax, tariff or duty from any amount payable to Licensor under this Agreement, then Licensee shall provide Licensor with copies of all documentation required in connection with such withholdings and shall provide to Licensor all assistance requested by Licensor in applying for relief from such withholding obligations and in substantiating corresponding tax, duty or tariff credits or deductions which may be available to Licensor with respect to such withholding under applicable law.

Seller furthermore guarantees that such licences will remain in force for the full life of this contract.

(a) All Canadian export taxes, duties and charges, whether existing or enacted subsequent to the date of this Agreement, on the Material or contained metals or on commercial Legal*7363548.3 documents relating thereto or on the shipments of Materials themselves, shall be to the account of and paid by the Seller.
(b) All import taxes, duties and other charges levied in any country through which a shipment of Material may pass or in the country of destination (the People’s Republic of China), whether existing or enacted subsequent to the date of this Agreement, on the Material or contained metals or on commercial documents relating thereto or on the shipment of Materials themselves, shall be to the account of and paid by the Buyer.
TAXES AND TARIFFS. Any taxes and tariffs imposed by federal, state or other governmental authority on the sale, use, manufacture, import, export, or processing of the goods referred to herein, or on the material and services used therein, may be added to Seller’s invoices and shall be paid by Buyer in addition to the quoted prices, unless Buyer furnishes Seller with appropriate exemption certificates.
TAXES AND TARIFFS. Fulcrum and/or the Owner under an applicable PO shall be responsible for paying all sales, use and similar taxes and tariffs of any kind (including, without limitation, local, state, province, federal, or national) applicable to the sale, delivery and transfer of a Core System under the applicable PO. All such amounts will either be paid directly by Fulcrum and/or the Owner to applicable taxing authorities, or paid by Seller and reimbursed by Fulcrum and/or the Owner. It is the duty of Fulcrum and/or the Owner to establish exemption to any taxes, tariffs, duties or fees and to fully indemnify Seller if such information is incorrect.
TAXES AND TARIFFS. All pricing hereinafter is subject to standard sales taxes and tariffs as per federal and provincial law. Data Rate: Maximum burst rates for the service is AS PER YOUR RATE PLAN. Additional Services: In addition to IP connectivity ABC will supply customer with email accounts, IP assignments and dial up connectivity per calendar month AS PER YOUR RATE PLAN. Security: Data security remains as Customer’s responsibility. ABC assumes no liability for any damages incurred as a result of broadband data connectivity. ABC recommends that all systems with broadband internet connections be protected by a hardware firewall. Outages: ABC will endeavour to monitor and repair all wireless links in a timely fashion. To ensure prompt service it is advisable that Customer contacts ABC in the event of a service outage. ABC assumes no liability for any damages incurred by an internet service interruption. Radio Hardware: All rental radio hardware remains sole property of ABC. Any damages or service outages caused as a result of misuse of radio or computer equipment may result in additional fees payable to ABC. Customer assumes liability for any physical damages and or vandalism to radio hardware present at Purchasers property. Signal Level: ABC ensures that wireless signal levels are within an acceptable range at the time of installation. Changes to signal level, resulting from changes in the path to the customer's wireless unit, may occur over time. ABC is not responsible for any such changes that may compromise the signal quality. ABC reserves the right to terminate the wireless service if the signal level drops below the acceptable range. Resolutions of Controversies or Claims: The parties agree that this agreement has been entered into in British Columbia. In the event of any dispute arising out of this agreement such dispute shall be resolved by arbitration if agreed upon by all parties, and if not agreed upon, by way of litigation for which the parties hereto agree proper venue shall be in the Province of British Columbia. This agreement shall be construed and governed in accordance with the laws of the Province of British Columbia. In the event of any dispute the prevailing party shall be entitled, in addition to any other relief, to a sum equal to their reasonably incurred attorneys fees and costs.
