Tenant’s Parking Spaces. Effective as of the Suite 350 Commencement Date, Section 1.18 of the Lease is hereby amended and restated as follows: “Tenant and its employees, agents and invitees shall have the non-exclusive right to use up to one hundred fourteen (114) parking spaces (a ratio of 5:1000 rsf); provided, however, Tenant shall lease on a “must take” basis no less than sixty-eight (68) parking spaces (a ratio of 3:1000 rsf). All Parking Spaces shall be in the parking garage adjacent to the Building (the “Adjacent Garage” or “Xxxxxxx Garage”); provided, however, Tenant may elect to convert up to ten (10) of the parking spaces to be designated as reserved vehicular parking spaces in the parking garage associated with the Building (the “Building Garage”) for the Lease Term, as same may be extended. Tenant’s use of the Parking Spaces is subject to (1) such reasonable Rules and Regulations (as defined herein) as Landlord may promulgate from time to time and (2) rights of ingress and egress of other tenants and their employees, agents and invitees. None of the Parking Spaces shall be assigned. Once any Parking Spaces are surrendered (provided Tenant must always have minimum of sixty-eight (68) Parking Spaces in the Adjacent Garage), then Tenant may only re-lease such spaces subject to availability.”

Tenant’s Parking Spaces. Tenant shall have the right, but not the obligation, to license from Landlord throughout the Term of the Lease, up to thirty-one (31) non-exclusive, unreserved, first-come first-served parking spaces (“Tenant’s Standard Parking Spaces”) in the Project’s parking facilities (the “Garage”) at the parking ratio of two and three tenths (2.3) per each one thousand (1,000) rentable square feet of the Premises. However, as an accommodation to Tenant, until the Building reaches an eighty-five percent (85%) occupancy level (as reasonably determined by Landlord), and subject to availability (as reasonably determined by Landlord), Tenant may license up to nine (9) additional non-exclusive, unreserved, first-come first-served parking spaces (“Tenant’s Additional Parking Spaces”), for an overall parking ratio of three (3) parking spaces per each one thousand (1,000) rentable square feet of the Premises. Tenant’s Standard Parking Spaces and Tenant’s Additional Parking Spaces are hereinafter collectively referred to as “Tenant’s Parking Spaces,” all of which shall be subject to such terms, conditions and regulations as are from time to time applicable to patrons of the Garage. The rate payable by Tenant for Tenant’s Parking Spaces (including tax) shall be as set forth hereinbelow: Months 01 – 24: Tenant’s Standard Parking Spaces: Tenant’s Additional Parking Spaces: $0.00 per parking space, per month $100.00 per parking space, per month Months 25 – 48: Tenant’s Parking Spaces: $100.00 per parking space, per month Months 49 – 66: Tenant’s Parking Spaces: $150.00 per parking space, per month During the Option Term (as defined in Exhibit J), if any, the parking rate shall be the rate charged from time to time to patrons of the Garage for other non-exclusive, unreserved, first-come, first-served parking spaces. Throughout the Term, including the Option Term, if any, Tenant shall have the right at any time and from time to time, on at least forty-five (45) days’ prior notice to Landlord (which notice shall designate the first calendar month for the effective date of Tenant’s desired change) to increase or decrease the number of Tenant’s Parking Spaces but in no event shall Tenant have the right to license more than the then-applicable ratio set forth in the first paragraph of this Section 1. Tenant’s Parking Spaces. During the Term of this Lease (as the same may be extended or renewed), Landlord shall provide to Tenant the number of parking spaces specified in Subparagraph 1.21 hereof for use by Tenant's employees or a nonexclusive basis in the common parking areas for the Building within the Project, as designated by Landlord from time to time. Landlord shall at all times have the right to establish and modify, on a non- discriminatory basis, the nature and extent of the parking areas for the Building and Project (including whether such areas shall be surface, underground and/or other structures) as long as Tenant is provided, on a non-discriminatory basis, the number of parking spaces designated in Subparagraph 1.21. Tenant and its employees shall be provided access to the parking areas for the Project seven (7) days a week and twenty-four (24) hours per day. Throughout the entire Lease Term (as the same may be extended and/or renewed) the parking spaces provided to Tenant as specified in Subparagraph 1.21 and visitor parking for Tenant's guests and invitees shall be free of charge. However, all costs of operating, maintaining and repairing the parking areas shall be included as Operating Expenses.
Tenant’s Parking Spaces. The number of Tenant’s Parking Spaces, as defined in Section 1.18 of the Lease, shall be increased by twenty (20) spaces on the Expansion Commencement Date. Accordingly, the total number of Tenant’s Parking Spaces shall be increased to 109 spaces. None of the additional Parking Spaces shall be assigned or reserved; provided, however, that Tenant shall have the right to convert twenty percent (20%) of such additional Parking Spaces (e.g., four (4) of the Parking Spaces attributable to the Expansion Premises) to reserved Parking Spaces upon thirty (30) days’ prior written notice to Landlord at no additional charge during the initial Lease Term, the location of which shall be reasonably determined by Landlord following consultation with Tenant.

Tenant’s Parking Spaces. (a) For so long as Tenant leases 40,785 rentable square feet of space, the number of Parking Spaces to which Tenant is entitled under Section 1.17 of the Lease shall increase to a total of forty (40) parking spaces in such areas of the parking facilities associated with the Building as may be reasonably designated by Landlord from time to time. None of the Parking Spaces shall be assigned or reserved. (b) Monthly parking rent, as set forth in Section 1.18 of the Lease, applicable to the Expansion Premises shall be at market rates for the Building per parking space. Monthly parking rent may increase upon thirty (30) days’ prior written notice to Tenant to Landlord’s then standard rate; provided, however, the original twenty-six (26) parking spaces shall continue to be $90.00 per month per parking space until April 30, 2007.
