Tenant's Permits. Landlord agrees upon request by Tenant to execute or join in the execution of any application for any permits or licenses (including without limitation, zoning changes) which may be necessary in connection with the construction of any buildings or other improvements on the demised premises or the making of any alterations, additions and repairs thereto. All such permits and licenses shall be applied for and secured at Tenant's expense in Tenant's name alone unless Landlord's name is also required in connection therewith by such governmental authority. In addition, Landlord agrees to cooperate fully with Tenant, without cost or expense to Landlord, in connection with the exercise by Tenant of any of its rights under this Lease. In particular, and without limitation, Landlord agrees to execute utility easements and such other documents as Tenant may reasonably request.
Tenant's Permits. The Tenant will provide evidence satisfactory to the Landlord prior to commencing any work in respect of the Premises that the Tenant has obtained at its expense, all necessary consents, permits, licenses and inspections from all governmental and regulatory authorities having jurisdiction and will post permits when required by law. Should the Tenant fail to obtain any required consent, permit, license, inspection or certificate, the Landlord may, but will not be obligated to, obtain it on behalf of the Tenant at the Tenant's expense.
Tenant's Permits. Before starting the Tenant Improvements, Tenant shall procure, and provide Landlord with copies of, all permits, licenses, consents, notices and other approvals necessary to commence such Work from all public and quasi-public authorities with jurisdiction. During and upon completion of the Tenant Improvements, Tenant shall: (a) procure, and provide Landlord with copies of, all necessary permits, licenses, consents and other approvals, (b) comply with the directions, orders and other requirements of all building and other inspectors and representatives of public and quasi-public authorities with jurisdiction; and (c) comply with the reasonable requirements of any insurance underwriting board or insurance carrier insuring Tenant, Landlord or the Premises. Tenant shall keep Landlord generally informed of the status of, and Landlord shall have the right to participate and shall cooperate with Tenant in the procurement of, Tenant's building permit for the Tenant Improvements.
Tenant's Permits. All permits, licenses, and approvals (other than the Building Permit) necessary under applicable Legal Requirements for Tenant's proposed use of the Premises for the Permitted Use.
Tenant's Permits. Tenant shall obtain, at Tenant's sole cost and expense, on or before the Substantial Completion Date all Tenant Permits, and shall provide Landlord with copies of all Tenant Permits (the "Permit Condition").
Tenant's Permits. Tenant shall, at its own cost and expense, secure and maintain throughout the Term, all necessary licenses and permits from such authorities as shall be necessary for, or incidental to, the conduct of its business in the Premises and shall comply with all Laws relating to the operation of its business. Landlord does not covenant, warrant or make any representation that any particular license or permit that may be required in connection with the operation of Tenant’s business will be granted, or if granted, will be continued in effect or renewed.
Tenant's Permits. Tenant shall apply for, and thereafter use commercially reasonable efforts to obtain, all necessary governmental permits and approvals as shall be necessary for Tenant’s Work (“Tenant's Permits”). Landlord agrees to cooperate with and provide reasonable assistance to Tenant in connection with Tenant’s pursuit of Tenant's Permits, provided that Landlord shall have no obligation to incur any out of pocket cost or expense in connection therewith; provided, further, that if Tenant requests Landlord's reasonable assistance to secure Tenant's Permits and Landlord believes such efforts will require Landlord to incur any out-of-pocket cost or expense, then Landlord will provide such reasonable assistance but Tenant shall reimburse Landlord for any out-of-pocket cost or expense reasonably incurred by Landlord in connection therewith promptly following Landlord's demand therefor. Notwithstanding the foregoing, the parties acknowledge that the pursuit of Tenant's Permits shall be Tenant's and not Landlord's responsibility.
Tenant's Permits. Within the later of ninety (90) days after the Lease Commencement Date or 90 days after receipt by Landlord of final site plan approval for the Center, Tenant shall apply to the appropriate governmental authorities for a building permit and any other permits (the “Permits”) required to construct and operate a branch banking office with drive-through facilities on the Premises under this Lease, and shall diligently attempt to obtain the Permits after it applies. If Tenant have not obtained, despite all diligent efforts by Tenant, all of the Permits within 120 days after the Lease Commencement Date, Landlord or Tenant may terminate this Lease upon ten (10) days’ written notice to the other party. Notwithstanding the above, Tenant shall not be obligated to apply for the Permits prior to the date on which Tenant acquires the Approvals as set forth in Section 3.5 hereof, and the Possession Date and the date on which Landlord may exercise the termination right as set forth in this Section 3.2 shall be extended for the number of days of any period during which Tenant is excused from its application for the Permits under the provisions of this Section 3.2.
Tenant's Permits. Tenant shall submit plans pursuant to 3.2 above. Tenant shall within thirty (30) days thereafter submit its plans to the appropriate governmental agency or agencies for approval along with the required processing fee(s). Tenant shall within twenty-four (24) hours thereafter provide Landlord with proof of such payment and a copy of the receipt issued by the agency or agencies to which the plans have been submitted. If Tenant fails to provide such documentation within the time frame permitted Tenant shall be considered in default of this Lease and Landlord, at Landlord’s sole discretion may terminate this Lease and release such space to another prospective tenant. Both Landlord and Tenant agree that due to the difficulty of establishing monetary damages that may be suffered by Landlord upon Tenant’s non-compliance with this Paragraph, Landlord shall be entitled to retain any deposits or other moneys paid by Tenant as initial consideration for Landlord to enter into this Lease with Tenant.
Tenant's Permits. Tenant shall, at its own cost and expense, secure and maintain throughout the Term, all necessary licenses and permits from such Authorities as shall be necessary for, or incidental to, the conduct of its business in the Leased Premises and shall comply with all Laws relating to the operation of its business. Landlord does not covenant, warrant, or make any representation that any particular license or permit that may be required in connection with the operation of Tenant's business will be granted, or if granted, will be continued in effect or renewed, and any failure to obtain, maintain, or renew such license or permit, or its revocation after issuance, shall not affect Tenant's obligations under this Lease.
