The Merchant must initiate the ISXPay Service for each End User as required; and

The Merchant must. 2.2.1. comply with the requirements of the GDPR; and 2.2.2. take all steps required by ISXPay (including passing on or including any privacy notices, collection notices or similar privacy statements to End Users) to ensure that the collection of Personal Data by ISXPay is notified to End Users, 2.2.3. in conjunction with the collection of Payment Instrument Data from End Users.
The Merchant must. 2.7.1. at all times have the POS device plugged in and connected to an operational communication Network Authorised by VPS in order to update vital information on a daily basis; 2.7.2. assume responsibility for the provision of power and any other infrastructural modifications required for the POS device; 2.7.3. only accept a Fallback transaction with PIN 2.7.4. keep and operate the POS device with due care and in a secure manner; and 2.7.5. ensure that the POS device reflects the correct date and time.
The Merchant must. 9.1.1. not use the Zash App or Zash Solution in any unlawful manner, for any unlawful purpose, or in any manner inconsistent with these terms, or act fraudulently or maliciously, for example, by hacking into or inserting malicious code, such as viruses, or harmful data, into the Zash App, or Zash Solution, or any operating system; 9.1.2. not infringe DNAP’s intellectual property rights or those of any third-party in relation to the Merchant’s use of the Zash App, or Zash Solution, including by the submission of any material (to the extent that such use is not licensed by these terms); 9.1.3. not transmit any material that is defamatory, offensive or otherwise objectionable in relation to the Merchant’s use of the Zash App or Zash Solution; 9.1.4. not use the Zash App, or Zash Solution in a way that could damage, disable, overburden, impair or compromise DNAP’s systems 9.1.5. not collect or harvest any information or data from the Zash App, or Zash Solution or DNAP’s systems or attempt to decipher any transmissions to or from the servers running any service DNAP provides to the Merchant.
The Merchant must. 5.1.1. not engage in any practice prohibited by the Payment Scheme Rules when accepting Card payments, and in particular the Merchant must: 5.1.1.1. not engage in any practice that discriminates against or discourages the use of a Card in favour of any other acceptance brand, including the levying of surcharges or the imposition of minimum or maximum transaction amounts; 5.1.1.2. abide by and ensure that all equipment and software it uses in connection with Card Transactions and the storage and/or processing of Card data complies with, any payment card industry or payment application data security standards of any Payment Scheme as updated from time to time (“PCI DSS”). 5.1.2. accept and apply 3D-Secure processes for all Transactions where mandated by regulation or the Payment Method Acquirer or if requested by Cross Switch; 5.1.3. only accept payments and/or process refunds: 5.1.3.1. from Customers in connection with goods and/or services supplied by the Merchant; 5.1.3.2. in respect of goods and/or services which: 5.1.3.2.1. commonly fall within its business identified to Cross Switch during onboarding or as updated to Cross Switch from time to time; 5.1.3.2.2. the Customer would reasonably expect to receive; 5.1.3.2.3. in respect of goods or services the provision of which is in terms of Applicable Laws; 5.1.4. identify itself to its customers as the seller of the goods and services and will display its customer service contact details, including email address and telephone number on the website; 5.1.5. display its full terms and conditions, including comprehensive details of its return and refund policies; 5.1.6. if accepting a Transaction payment using any Payment Method not price that transaction higher than the Merchant’s standard, or usual, prices that it would charge to any other customer using any other type of payment method, including cash; 5.1.7. not refuse to transact for any goods or services on the basis that the customer wishes to use a particular Payment Method to pay for such transaction; 5.1.8. obtain authorisation for Transactions via the CS+ Platform; 5.1.9. retain a copy of all relevant information relating to a Transaction for at least 5 years from the date of the Transaction; and 5.1.10. comply with any additional security, authentication, risk control or other requirements imposed by Cross Switch or a Payment Scheme.
The Merchant must. (a) accept Nominated Cards in accordance with the Agreement; and (b) stop accepting a Nominated Card immediately if: - ANZ gives the Merchant a notice to do so; or - any of the events described in condition 2(ii) occur.
The Merchant must comply with the requirements of the GDPR; and
