TIME AND PERFORMANCE. The work and services under this Contract shall be completed no later than the Completion Date. The Vendor shall submit for Contracting Party’s approval a detailed schedule for the performance of the work and services which shall include allowances for periods of time required for Contracting Party’s review and approval of submissions by Vendor. Time limits established by this detailed schedule shall be consistent with the Completion Date. Time is of the essence of this Vendor Contract. If the Vendor fails to comply with Section A; Basic Terms, Paragraph c, [Completion Date], the Vendor shall be subject to any and all consequential damages unless the delays are beyond the reasonable control of the Vendor.

TIME AND PERFORMANCE. The Consultant’s services shall commence upon execution of this Agreement by both parties. Once approved by the Client, the Consultant shall complete the tasks described in the Scope of Services within 18 months from the date of execution of this Agreement, unless delayed by circumstances beyond Consultant’s control. The Consultant will exercise reasonable skill, care and diligence in the performance of its services, and will carry out its responsibilities in accordance with the customarily accepted planning practices in Consultant’s community. The Client shall be responsible for the timely delivery of data and support information requested by the Consultant in a manner that will allow the Consultant the ability to perform its services within the time frame noted above.

Given the occasional need for the Police Liaison Officer to work at school events that take place outside or beyond the hours of the normal school day (including but not limited to those detailed in Section 3.2, a through e), flexibility in scheduling is understood and accepted by all parties with the understanding that on average, forty-two (42) hours of work will generally be provided per week. The Police Liaison Officer shall meet with the School District’s Superintendent on a weekly basis to determine the officer’s work schedule for the successive week. To the extent the assigned Police Liaison Officer will not be present to perform the services required by this Agreement, the City will provide a substitute Police Liaison Officer at no additional cost to the School District. If the City becomes aware that the Police Liaison Officer will be absent from the School District’s premises, then the Police Liaison Officer or his supervisor at the City shall provide reasonable notice to the administration of the relevant school(s) of the Police Liaison Officer’s absence. Generally, the duties performed by the Police Liaison Officer shall be as follows:

  • Excused Performance In case performance of any terms or provisions hereof shall be delayed or prevented because of compliance with any law, decree or order of any governmental agency or authority, whether the same shall be of Local, State or Federal origin, or because of riots, war, public disturbances, strikes, lockouts, differences with workmen, fires, floods, acts of God or any other reason whatsoever which is not within the control of the party whose performance is interfered with and which, by the exercise of reasonable diligence, said party is unable to prevent, the party so suffering may, at its option, suspend, without liability, the performance of its obligations hereunder during the period of such suspension of performance of duties hereunder.
