Common use of Time Off for Union Business Clause in Contracts

Time Off for Union Business. ‌ (a) Without pay - with reasonable written notice leave of absence without pay and without loss of seniority will be granted: (1) to an elected or appointed representative of the Union to attend conventions of the Union and bodies to which the Union is affiliated; (2) for elected or appointed representatives of the Union to attend to union business which requires them to leave their general work area; (3) for employees who are representatives of the Union on a bargaining committee to attend meetings of the Bargaining Committee; (4) up to seven employees on a component bargaining committee to carry on negotiations with the Employer; however, the Components reserve the right to use up to three additional persons for technical information or advice, who shall also be covered by the provisions of this clause; (5) to employees called by the Union to appear as witnesses before an arbitration board, the Labour Relations Board, or the Human Rights Tribunal; (6) to employees designated to sit as an observer on a selection panel in accordance with Clause 12.1. (b) With pay - leave of absence with basic pay and without loss of seniority will be granted to one employee per component (two employees where the component has 7,500 or more employee members) and to employees who are table officers of the BCGEU who are representatives of the Union on the Union's Master Bargaining Committee to carry on negotiations with the Employer. (c) To facilitate the administration of this clause when leave without pay is granted, the leave shall be given with basic pay and the Union shall reimburse the Employer for salary and benefit costs, including travel time incurred. Leave of absence granted under this clause shall include sufficient travel time. The Union shall provide the Employer with reasonable notice prior to the commencement of leave under this clause. It is understood that employees granted leave of absence pursuant to this clause shall receive their current rates of pay while on leave of absence with pay. The Employer agrees that any of the above leaves of absence shall not be unreasonably withheld. (d) The Employer shall grant, on request, leave of absence without pay: (1) for employees selected for a full-time position with the Union for a period of one year; (2) for an employee elected to the position of President or Treasurer of the B.C. Time spent by designated committee members attending meetings held on their day of the Union on the Union's Master Bargaining Committee to carry on negotiations with the Employerrest or outside their regularly scheduled hours of work shall not be considered time worked but such committee members shall receive equivalent time off at straight-time rate. (c) To facilitate the administration of this clause when leave without pay is granted, the leave shall be given with basic pay, substitution pay where applicable, and the Union shall reimburse the Employer for salary and benefit costs, including travel time incurredincurred within the workday. Benefit costs are defined as thirty-six percent (36%) of basic pay and substitution pay where applicable. Leave of absence granted under this clause shall include sufficient travel time. The Union shall provide the Employer with reasonable notice prior to the commencement of leave under this clause. It is understood that employees granted leave of absence pursuant to this clause shall receive their current rates of pay while on leave of absence with pay. The Employer agrees that any of the above leaves of absence absences shall not be unreasonably withheld. (d) The Employer shall grant, on request, Chief stewards" - leave of absence with current pay, benefits and without pay: loss of seniority will be granted to one (1) chief xxxxxxx for employees selected for up to a full-time position with the Union for a period combined maximum total of one year; (2) for an employee elected to the position of President or Treasurer of the B.C. Government and Service Employees' Union. three (3) for an employee elected days per year to any body to which deal with collective agreement related problems on the Union is affiliated for a period of one year and worksites within the leave contract area. Further leaves will be granted as required as per Clause 2.10(a)(2). The chief xxxxxxx shall be renewed upon requesta member of the Joint Labour Management Committee.

(e) Chief Stewards - leave of absence with basic pay, benefits and without loss of seniority will be granted to two (2) Chief Stewards for up to a combined maximum of six (6) days per year to deal with Collective- Agreement-related problems on the worksites within the Contract Area. Further leaves will be granted as required as per Clause 2.10(a)(2). (f) The Employer agrees that any of the above leaves of absence shall not be unreasonably withheld. (d) The Employer shall grant, on request, leave of absence without pay: (1) for employees selected for a full-time position with the Union for a period of one year; (2) for an employee elected to the position of President or Treasurer of the B.C.
