Time Off for Union Business. 9.01 Time off without loss of regular earnings will be granted to Employees on the following basis: (a) When acting as members of the negotiating committee during negotiations with the Board for renewal of the Collective Agreement and shall not exceed three (3) in number. This shall apply to preparations on the particular day assigned to negotiations, or on the afternoon of the day preceding negotiations. (b) When involved in discussions related to the processing of grievances pursuant to the Grievance Procedure as outlined in this Agreement, at no time shall the number of Employees involved exceed three (3) in number. (c) Local Officers and designated representatives, not to exceed five (5) in total, for time spent meeting with representatives of the Board pursuant to Article 11 (Joint Consultation). (d) Union Stewards for reasonable time to satisfactorily conduct their duties as required by this Agreement. 9.02 Time off, without pay, shall be granted to members of the Union who: (a) Are elected, as delegates, to attend the Annual Convention of The Alberta Union of Provincial Employees. (b) Are designated as delegates representing the Union at conventions, conferences and workshops of other employee organizations. (c) Are members of the Local Bargaining Committee not exceeding seven (7) in number for time spent in preparation for negotiations. A maximum of twenty-one (2l) staff days in a year in which negotiations are conducted shall apply and shall not exceed seven (7) staff days at any one time. (d) Are elected to the Union Executive Committee to attend scheduled meetings of the Committee, this shall be limited to two (2) members at any one time. (e) Are elected to the Provincial Executive of the Union to attend the Union's general meetings, this shall be limited to two (2) in number at any one time. (f) Are members of the Local who serve on the Provincial Standing Committees to attend regular committee meetings normally held once every two (2) months. 9.03 In all of the foregoing provisions the Board shall grant the required time off provided that five (5) work days notice is given prior to the designated day(s) off. If the Employee is unable to give the required notice, or where the absence of the Employee will cause a serious disruption of work or other difficulty the Board may refuse the leave. Upon receipt of the notice, the Board shall provide the Employee with a response within three (3) working days, where possible. In the event that the leave is denied, the Board shall inform the Employee in writing. 9.04 To facilitate the administration of Clause 9.02 the Board will grant the leave of absence with pay and invoice the Union for the Employee's salary or for the replacement salary costs, whichever is greater. 9.05 No Employee shall conduct any Union business during working hours other than that provided for in this Agreement, unless authorized by the Board.

Time Off for Union Business. 9.01 Time off Subject to Clause 9.03, time off, without loss of regular earnings earnings, will be granted provided to those Employees who have been designated by the Local as authorized Local representatives to conduct official Union business for time spent: (a) meeting with representatives of the Employer, not to exceed two (2) of a committee of six (6) members, during the formal negotiating of a Collective Agreement; (b) by a Union Xxxxxxx for the purposes of Employee support including investigating a complaint; in discussing written grievances as outlined in the grievance procedure; and providing representation at a formal disciplinary interview, duty to accommodate meeting, or return to work meeting. Time away from the Xxxxxxx’x workplace shall be done in accordance with Clause 22.12(a); (c) attending the Employee Management Advisory Committee meetings, with Local representation of up to six (6) in number; (d) meeting with the Employer at formal Safety Committee meetings during normal working hours, and for meetings of the Joint Work Site Health and Safety Committee; (e) attending Employer initiated Employee Assistance Program meetings; (f) attending the Employer orientation sessions for new Employees; (g) participating in other Employer initiated meetings where the Employer deems that Local representation is required. 9.02 Subject to Clause 9.03, time off, without pay, shall be provided to Union Members on the following basis: (a) When acting members elected as members of the negotiating committee during negotiations with the Board for renewal of the Collective Agreement and shall not exceed three (3) in number. A maximum of twenty-one (2l) staff days in a year in which negotiations are conducted shall apply and shall not exceed seven (7) staff days at any one time.normal working hours; (d) Are elected to members of the Union Executive Committee Committee, to attend scheduled meetings of the Committee, this shall be limited to two (2) members at any one time.meetings; (e) Are elected to members of the Provincial Executive of the Union Union, to attend the Union's general meetings, this shall be limited to two (2) in number at any one time.; (f) Are members of the Provincial Executive Standing Committees of the Union to attend regular committee meetings; (g) members of the Local who serve on 038 Bargaining Committee, not to exceed twelve (12) members, three days to prepare for negotiations before the Provincial Standing Committees formal negotiations begin; (h) four (4) of six (6) members of the Local 038 Bargaining Committee, for time spent meeting with representatives of the Employer during the formal negotiation of a collective agreement and for Union preparatory meetings during these negotiations; (i) the Chairperson of the Local shall collectively be relieved of up to ten percent (10%) of a FTE (full time equivalent) to attend regular committee meetings normally held once every two (2) monthsto Local Union business. 9.03 In all of the foregoing provisions the Board shall grant the required time off provided that shall be granted except where operational difficulty will arise. The Union shall provide the Employer’s Human Resources Office with a copy of the request for time off. Employees shall provide a minimum of five (5) work days notice when requesting time off under Clause 9.02; however, consideration may be given in cases where the five (5) work days notice is given prior to the designated day(s) off. If the Employee is unable to give the required notice, or where the absence of the Employee will cause a serious disruption of work or other difficulty the Board may refuse the leave. Upon receipt of the notice, the Board shall provide the Employee with a response within three (3) working days, where possible. In the event that the leave is denied, the Board shall inform the Employee in writingnot provided. 9.04 To facilitate the administration of Clause 9.02 9.02, the Board Employer will grant the leave of absence with pay and invoice the Union for the Employee's ’s salary and applicable allowances, or for the replacement salary costs, whichever is greater. The Employer shall bill the Union within sixty (60) days of leave of absence and the Union shall make payment within thirty (30) calendar days of the date of receipt of the invoice. 9.05 No Employee shall conduct any Union business during working hours other than that provided for in this Agreement, unless authorized by the Board.

This shall apply to preparations on the particular day assigned to negotiations, or on the afternoon of the day preceding negotiations. (b) When involved in discussions related to the processing of grievances pursuant to the Grievance Procedure as outlined in this Agreement, at no time shall the number of Employees involved exceed three (3) in number. (c) Local Officers and designated Authorized Union representatives, not to exceed five (5) in total, number for time spent meeting with representatives of the Board pursuant to Article 11 Employer at formal Employee Relations Committees where matters of mutual concern are discussed; (b) For time spent meeting with the Employer at formal Safety Committee meetings during normal working hours, and for meetings of the Joint Consultation)Work Site Health and Safety Committee as provided by the Occupational Health and Safety Act. 11.02 Subject to Clauses 11.01 and 11.04, in continuous operations, when (da) Union Stewards an Employee is not scheduled to work; (b) it is not possible to schedule the meeting during a time when the Employee is scheduled to work; and (c) no alternate attendee is available or appropriate to attend, an Employee who attends an Employee Relations Committee, Joint Work Site Health and Safety Committee or formal Safety Committee meeting shall be paid at the basic hourly rate of pay for reasonable time to satisfactorily conduct their duties as required by this Agreementa minimum of two (2) hours or the length of the meeting whichever is greater. Employees shall provide a minimum of five (5) work days notice when requesting time off under Clause 10.02; however, consideration shall still be given in cases where the five (5) days notice is given prior not provided. Where such time off is granted for an indeterminate period the Employee shall communicate with the Employer on a daily basis in respect to the designated day(s) off. If the Employee is unable to give the required notice, or where the absence date of the Employee will cause a serious disruption of work or other difficulty the Board may refuse the leave. Upon receipt of the notice, the Board shall provide the Employee with a response within three (3) working days, where possible. In the event that the leave is denied, the Board shall inform the Employee in writingreturn. 9.04 10.04 To facilitate the administration of Clause 9.02 10.02 of this Article, the Board Employer will grant the leave of absence with pay and invoice the Union for the Employee's salary and applicable allowances, or for the replacement salary costs, whichever is greater, which the Union shall promptly pay. 9.05 No Employee shall conduct any Union business during working hours other than that provided for in this Agreement, unless authorized by the Board.
