Common use of Transfer and Seniority Outside Bargaining Unit Clause in Contracts

Transfer and Seniority Outside Bargaining Unit. No employee shall be transferred to a position outside of the bargaining unit without the employees consent. If an employee is transferred to employment which is outside the bargaining unit, or is appointed to act temporarily for a period of greater than three (3) months in a position which is outside the bargaining unit, the employee shall retain accrued seniority rights for a period of six (6) months commencing from the day on which the transfer, promotion or acting appointment becomes effective. During the period of transfer, promotion or acting appointment outside of the bargaining unit an employee shall not accrue seniority, nor shall the employee be entitled to grieve under Article 8 of this Agreement. After the six (6) month period has expired, such an employee shall lose all seniority rights in the bargaining unit. If such an employee is transferred or promoted back to employment coming within the bargaining unit or ceases to act in a position outside the bargaining unit within the six (6) month period, the employee shall retain all accrued seniority in the bargaining unit and will again commence accruing seniority from the effective date of the employees return to a bargaining unit position.
