ULPs. The Union will withdraw the unfair labor practice (hereafter “ULP”) charge in NLRB Case 18-CA-272095 within three business days following ratification with prejudice. The withdrawal request must include the following statement: “Further processing of the case will not effectuate the purposes of the Act.” The union will copy Allina Health’s Vice President of Labor and Employee Relations on the withdrawal request. The Union will withdraw the following unfair labor practice (hereafter “ULP”) charge that was filed with the National Labor Relations Board (hereafter “NLRB”) within three business days following ratification with prejudice: 18-CA-265743. The union will copy Allina Health’s Vice President of Labor and Employee Relations on the withdrawal request. Allina Health will continue to process the related grievance. The Allina Health and the Union (on behalf of itself and the bargaining unit employees) further agree not to file any additional ULP charges with the NLRB over actions which occurred on or before the date of ratification of this Settlement by the Union bargaining unit employees.

ULPs. If the County or Association intends to file an unfair labor practice charge against 12 the other party, it shall give that party advance written notice of such intent and a reasonable 13 opportunity to meet to discuss the basis of such charge and possible resolution prior to filing the 14 charge, unless the delay needed for such a discussion would cause prejudice to the claim; in 15 the latter event, the notice and meeting is not excused, but may occur after the filing of the 16 charge.

  • COVID-19 Residents acknowledge that in March 2020 the World Health Organization declared a global pandemic of the virus leading to COVID-19. The Governments of Canada, the Province of Ontario, and local Governments responded to the pandemic with legislative amendments, controls, orders, by-laws, requests of the public, and requests and requirements to Humber (collectively, the “Directives”). It is uncertain how long the pandemic, and the related Directives, will continue, and it is unknown whether there may be a resurgence of the virus leading to COVID-19 or any mutation thereof (collectively, “COVID- 19”). Without limiting the generality of the foregoing paragraph, Humber shall not be held legally responsible or be deemed to be in breach of this Agreement for any damages or loss arising out of or caused by:

  • Probes Network hosts used to perform (DNS, EPP, etc.) tests (see below) that are located at various global locations.

  • Influenza Vaccination The parties agree that influenza vaccinations may be beneficial for patients and employees. Upon a recommendation pertaining to a facility or a specifically designated area(s) thereof from the Medical Officer of Health or in compliance with applicable provincial legislation, the following rules will apply:

  • SHOP DRAWINGS, PRODUCT DATA AND SAMPLES 4.12.1 Shop Drawings are drawings, diagrams, schedules and other, data specially prepared for the Work by the Contractor or any Subcontractor, manufacturer, supplier or distributor to illustrate some portion of the Work.

  • First sampling In the first sampling four lamps are selected at random. The first sample of two is marked A, the second sample of two is marked B.

  • Samples Physical examples of materials, equipment, or workmanship that are representative of some portion of the Work and that establish the standards by which such portion of the Work will be judged. The Contractor shall furnish for approval all samples required by the Contract Documents. The Work shall be in accordance with approved samples.

  • DEMONSTRATIONS/SAMPLES 9.1 Bidders shall demonstrate the exact item(s) proposed within seven (7) calendar days from receipt of such request from the Owners.

  • Influenza Vaccine Upon recommendation of the Medical Officer of Health, all employees shall be required, on an annual basis to be vaccinated and or to take antiviral medication for influenza. If the costs of such medication are not covered by some other sources, the Employer will pay the cost for such medication. If the employee fails to take the required medication, she may be placed on an unpaid leave of absence during any influenza outbreak in the home until such time as the employee has been cleared by the public health or the Employer to return to the work environment. The only exception to this would be employees for whom taking the medication will result in the employee being physically ill to the extent that she cannot attend work. Upon written direction from the employee’s physician of such medical condition in consultation with the Employer’s physician, (if requested), the employee will be permitted to access their sick bank, if any, during any outbreak period. If there is a dispute between the physicians, the employee will be placed on unpaid leave. If the employee gets sick as a reaction to the drug and applies for WSIB the Employer will not oppose the application. If an employee is pregnant and her physician believes the pregnancy could be in jeopardy as a result of the influenza inoculation and/or the antiviral medication she shall be eligible for sick leave in circumstances where she is not allowed to attend at work as a result of an outbreak. This clause shall be interpreted in a manner consistent with the Ontario Human Rights Code.

  • GPA 2. Students who have followed the Advisement Plan attached to this agreement will receive the agreed upon hours of transfer credit towards the hours required for the B.S. degree. Credits remaining to complete the identified B.S. degree will be available in partnership with HCCC and SUNY Poly.
