Bargaining Unit Employees means persons covered by a Collective Bargaining Agreement that requires contributions to this Plan.
Bargaining Unit Employees means all Employees who are covered by the Collective Bargaining Agreement between Seller and the United Food & Commercial Workers, AFL-CIO, Local 354 (the "Union") dated October 17, 1994 (the "Union Contract"), relating to hourly paid individuals at the Cedartown Facility, (2) the term "Non-Represented Employees" shall mean all employees of the Business other than Active Bargaining Unit Employees, (3) the term "Transferred Non-Represented Employees" shall mean all Non-Represented Employees who accept Buyer's offer of employment, (4) the term "Transferred Bargaining Unit Employees" shall mean all Bargaining Unit Employees who accept Buyer's offer of employment and (5) the term "Transferred Employees"

Bargaining Unit Employees has the meaning given such term in Section 4.4(b).
Bargaining Unit Employees means employees to whom the Public Service Act applies and who, as of September 1, 2012 are designated to be represented by the Alberta Union of Provincial Employees (“AUPE”) under the Collective Agreement Between The Government of Alberta and AUPE, dated May 17, 2011, as amended from time to time.
Bargaining Unit Employees means all employees of Seller, or any management company retained to provide services at the Property, who work at the Hotel-Related Units and are covered by the Union Contract. “Union Benefit Plans” shall mean all Employee Benefit Plans required to be contributed to as set forth in the Union Contract, except for any 401(k) plan, and, including, without limitation, all Multiemployer Plans. Seller also agrees to comply with its obligations under any collective bargaining agreement or applicable labor law with respect to the transaction contemplated by this Agreement, including, but not limited to, any applicable duty to bargain with or requirement of notification to any union regarding this sale.
Bargaining Unit Employees as defined in Section 10.1(f).
Bargaining Unit Employees means all employees of Seller or Manager who work at the Hotel and are covered by the Collective Bargaining Agreement (defined below). The provisions of this Agreement set forth in Sections 5.6(b) through Section 5.6(f) will apply to Purchaser or Manager, as applicable, to the extent and only to the extent that Seller immediately before the Closing has a corresponding and direct obligation to Hotel Employees or to Bargaining Unit Employees and to their union representatives, and the obligation of Purchaser or Manager, as applicable, thereunder will be only to the same extent as the obligation of Seller. The provisions of Section 5.6(f), and any obligation of Purchaser or Manager thereunder shall be to the same extent and have the same nature as that of Seller immediately before the Closing. The provisions of Section 5.6(h) will operate and be applied, if and only to the extent that Seller has an obligation to contribute to the Retirement Plan that runs directly to such plan. Nothing in this Section 5.6 is intended by its own force and without the consent of Purchaser to enlarge any obligation or commitment of Purchaser or Manager beyond the obligation or commitment that Seller has immediately before the Closing.
Bargaining Unit Employees. Purchaser shall assume on the Closing Date the collective bargaining agreements set forth on Schedule 5.1.18
Bargaining Unit Employees means those employees whose terms and conditions of employment are covered by a Collective Agreement and who are actively employed in the United States as of the Effective Time or whose seniority under the applicable Collective Agreement has not terminated as of such date.
