Usage Rules. Comcast shall, and shall cause the Systems and Comcast Services, to the extent such System and/or Comcast Service is distributing any Included Programs pursuant to this Agreement, to put into place and comply with the Usage Rules.

Aircall has agreements in place with regulated providers of electronic communications which provide Aircall with phone numbers from multiple countries. The provision of Aircall Numbers is subject to the numbering rules and regulatory practices applicable in the countries where Customer and and/or Users are located as well as in the relevant country(ies) from which the Aircall Numbers were purchased. Such rules and regulatory practices may change or be amended from time to time, and Aircall therefore reserves the right to modify the terms hereunder to the extent necessary to comply with such changes or amendments. Customer may purchase Aircall Numbers and assign them to an Account subject to the allocation requirements displayed upon Customer’s subscription to any Services. Customer shall use the Aircall Numbers in compliance with any and all applicable Law including such applicable allocation requirements. Aircall reserves the right, in its sole discretion, to cancel the subscribed Aircall Numbers for any or no reason, including in the event Customer, its Administrators and/or Users breach such applicable allocation requirements without penalty and without prejudice to its rights to claim damages therefore.
Usage Rules of the Original Agreement is deleted in its entirety and replaced with the following:
Usage Rules. DISH shall implement the following usage rules with respect to the Placeshifting Functionality (“Placeshifting Usage Rules”) no later than six (6) months following the Amendment Effective Date:
Usage Rules. Your use of Digital Content is subject to the Amazon Instant Video Usage Rules (the “Usage Rules”). The Usage Rules provide important information regarding your use of Digital Content, including the time period during which you are authorized to view different types of Digital Content (the “Viewing Period” for that Digital Content) and limitations on the number and type of Compatible Devices on which each type of Digital Content may be downloaded, streamed, and viewed.

DISH shall implement the following usage rules for each instance where Placeshifting Functionality is utilized with respect to a Licensed Picture (“Placeshifting Usage Rules”): In order to initiate a transmission of a Licensed Picture pursuant to the Placeshifting Functionality, the Customer must be authenticated into the applicable Account. DISH may determine its means of authentication in its sole discretion; provided that authentication for the Licensed Pictures shall use the same processes and procedures that DISH uses for its authentication of movie content provided on a PPV and VOD basis generally, and provided further that, at minimum, such authentication must take the form of a login using an ID and password. Notwithstanding the foregoing, if at any time DISH implements Local pairing of Approved Placeshifting Devices to Placeshifting-Enabled STBs, then authentication to an Account shall not be necessary to implement transmission of a Licensed Picture pursuant to such Local pairing. An Account may have no more than one (1) active Placeshifting Functionality session per Placeshifting-Enabled STB at any given time. [In addition, if a Placeshifting Functionality session is initiated on an Account, the Placeshifting-Enabled STB output associated with such session shall be incapable of playing back any content while such session is active.] [DISH to propose language regarding the disabling of TV2 output and/or the mirroring of Sling content on TV2 during active Sling session] Content Protection. A Placeshifting-Enabled STB that outputs a Licensed Picture in the Approved Format pursuant to this Amendment #2 must: [Protect and encrypt the Licensed Picture using the Widevine DRM with the settings set forth in Schedule A attached hereto and meeting the compliance and robustness rules associated with the Widevine DRM as approved by the Digital Entertainment Content Ecosystem (DECE).] [DISH to investigate with Widevine] Map the copy control information associated with each Licensed Picture; the copy control information (CCI) shall be set to “copy never”; and Deliver to the Placeshifting-Enabled STB system renewability messages from time to time obtained from Widevine Technologies, Inc. in a protected manner (to the extent Widevine has the means to deliver such system renewability messages in such manner).
Usage Rules. The License granted herein shall be subject to the “Usage Rules” set forth in this Section 2.2.4. Upon consummation by a Subscriber of a Subscriber Transaction for an Included Program during such Included Program’s License Period, the following Usage Rules shall apply:
2.2.4.1 The Included Program shall be viewable via any Set-Top Box or PC Tuner registered to such Subscriber’s account and, subject to Sections 2.2.4.2 and 2.2.4.3 below, via no more than a combined total of five (5) Portable Devices and/or PCs taken together (e.g., 3 Portable Devices and 2 PCs, or 1 Portable Device and 4 PCs, or 5 Portable Devices and no PCs, etc.). Licensee represents and warrants that the five (5) other Major Studios with whom Licensee has executed a license agreement as of the Effective Date have authorized Licensee to authorize their respective programs to be viewable on, for the payment of a single per-transaction fee by the Subscriber, a combined total of five
2.2.4.2 Any transfers of an Included Program from a Target Device to a Portable Device or a PC shall be solely by means of Side Loading; provided, however, that Licensee may be authorized to authorize IP Transfers if Licensee implements either (i) a secure and commercially reasonable DRM solution with proximity controls that is approved in writing by Licensor (such approval not to be unreasonably withheld or delayed) or (ii) a version of Windows Media DRM containing such proximity controls when such version becomes commercially available.
2.2.4.3 The Included Program shall be viewable only via Approved Devices registered to such Subscriber. Notwithstanding the foregoing, and without limiting any other provision of this Agreement, a PC and Portable Device receiving a transfer of an Included Program (directly or indirectly via a PC) from a PC Tuner need not be registered to such Subscriber’s account (provided that Licensee shall not advertise to Subscribers that such devices need not be registered) during a period commencing on the first full commercial deployment of the PC Tuner to Subscribers and ending on the earliest of (i) 12 months after the date on which Licensee receives the Microsoft PlayReady SDK suited for the PC Tuner; (ii) 12 months after the date on which the number of PC Tuners deployed to Subscribers exceeds 50,000, and (iii) a date on which Licensee enables the registration of PCs and Portable Devices receiving programming from the PC Tuner for all other Major Studios.
