Uses of Sick Leave. a. Sick leave shall be accrued before being taken, provided that an employee who participates in a sick leave pool shall not be prohibited from using sick leave otherwise available to the employee through the sick leave pool. b. Sick leave shall be authorized for the following: 1. The employee's personal illness or exposure to a contagious disease which would endanger others. 2. The employee's personal appointments with a health care provider. 3. The illness or injury of a member of the employee's immediate family, at the discretion of the supervisor. Approval of requests for use of reasonable amounts of sick leave for caring for a member of the employee's immediate family shall not be unreasonably withheld. "Immediate family" means the spouse, same-sex domestic partner, and the grandparents, parents, brothers, sisters, children, and grandchildren of both the employee and the spouse or same-sex domestic partner, and dependents living in the household. 4. The death of a member of the employee's immediate family, at the discretion of the supervisor. Approval of requests for use of reasonable amounts of sick leave, in addition to paid Bereavement Leave otherwise provided by this Policy, for the death of a member of the employee's immediate family shall not be unreasonably withheld. c. A continuous period of sick leave commences with the first day of absence and includes all subsequent days until the employee returns to work. For this purpose, Saturdays, Sundays, and official holidays observed by the State shall not be counted unless the employee is scheduled to perform services on such days. During any seven (7) day period, the maximum number of days of sick leave charged against any employee shall be five (5). d. An employee who requires the use of sick leave should notify the supervisor as soon as practicable. e. An employee who becomes eligible for the use of sick leave while on approved annual leave shall, upon notifying the supervisor, substitute the use of accrued sick leave to cover such circumstances.

Certification. If an employee's request for absence or absence exceeds four (4) consecutive 1678 days, or if a pattern of absence is documented, the University may require an employee to 1679 furnish certification issued by an attending health care provider of the medical reasons 1680 necessitating the absence and/or the employee's ability to return to work. If the medical 1681 certification furnished by the employee is not acceptable, the employee may be required to 1682 submit to a medical examination by a health care provider who is not a University staff member 1683 which shall be paid for by the University. If the medical certification indicates that the employee is 1684 unable to perform assigned duties, the President or representative may place the employee on 1685 compulsory leave under the conditions set forth in Article 17.8(C) below. 1686 (4). Transfer of Credits. 1687 a. When an employee is reemployed by the University within 100 days, the full 1688 balance of accrued sick leave shall accompany the employee unless the employee has received 1689 a lump sum payment for accrued sick leave. 1690 b. When an employee moves to a position in state government, the transfer of 1691 unused sick leave from the University shall be governed by the rules of the plan to which the 1692 employee is transferring. 1693 c. The transfer of unused sick leave from a local government to a university position 1694 is not permitted unless a reciprocal agreement in writing between the University and the previous 1695 employing entity is in effect. 1696 (5). Payment for Unused Sick Leave. 1697 a. An employee appointed on or after January 1, 2014, or with less than ten (10) 1698 years of continuous University service, as defined herein, who separates from the University shall 1699 not be paid for any unused sick leave. 1700 b. An employee appointed before January 1, 2014, and who has completed ten (10) 1701 or more years of University service, has not been found guilty or has not admitted to being guilty 1702 of committing, aiding, or abetting any embezzlement, theft, or bribery in connection with University 1703 employment, or has not been found guilty by a court of competent jurisdiction of having violated 1704 any State law against or prohibiting strikes by public employees, and separates from the University 1705 because of retirement for other than disability reasons, termination, or death, shall be 1706 compensated at the employee's current regular hourly rate of pay for one-fourth of all unused 1707 accrued sick leave ; provided that the payment shall not exceed 480 hours. 1708 c. Upon layoff, an employee appointed before January 1, 2014, and with ten (10) 1709 or more years of University service, shall be paid for unused sick leave as described in Article 1710 17.8(A)(5)(b), above. 1711 d. An employee shall not be carried on the payroll beyond the last official day of employment, except that an employee who is unable to perform duties because of a disability may be continued on the payroll until all accrued sick leave is exhausted.

"Immediate family" ―Immediate family‖ means the spouse, same-sex domestic partner, spouse and the grandparents, parents, brothers, sisters, children, and grandchildren of both the employee faculty member and the spouse or same-sex domestic partnerspouse, and dependents living in the household. 4. The death of a member of the employee's faculty member’s immediate familyfamily (as defined in 19.9(a)(2)b.3, at the discretion of above), in consultation with the supervisor. Approval of requests for use of reasonable amounts of sick leave, in addition to paid Bereavement Leave otherwise provided by this Policy, leave for the death of a member of the employee's immediate faculty member’s family shall will not be unreasonably withheld. c. A continuous period of sick leave commences with the first (1st) day of absence and includes all subsequent days until the employee faculty member returns to work. For this purpose, Saturdays, Sundays, and official holidays observed by the State shall University will not be counted unless the employee faculty member is scheduled to perform services on such days. During any seven (7) day period, the maximum number of days of sick leave charged against any employee shall faculty member will be five (5). d. Approval of requests for use of reasonable amounts of sick leave for caring for a member of the employee's immediate family shall not be unreasonably withheld. "Immediate family" means the spouse, same-sex domestic partner, and the grandparents, parents, brothers, sisters, children, and grandchildren of both the employee and the spouse or same-sex domestic partner, and dependents living in the household. 4. The illness Death of an aunt, uncle, nephew, xxxxx, sister-in-law, brother-in-law or injury other relative of employee or spouse who was not, at the time of their death, a permanent resident of the employee’s household (sick leave usage hereunder to be limited to one (1) day for actual attendance of funeral unless the employee requests and receives the Employer’s advance approval of additional time). 4. Medical, dental or optical examination or treatment of employee, or a member of his/her immediate family which requires the presence of the employee, and which cannot be scheduled during non-working hours. 5. If a member of the employee's ’s immediate familyfamily who does not reside in the same household as the employee contracts an illness or is injured and requires the attendance of the employee, including transport. The amount of sick leave that may be used for this purpose shall be limited to twenty- four (24) hours in any one calendar year, except for a catastrophic illness or hospitalization, then additional sick leave may be granted at the discretion of the supervisorEngineer. 6. Approval If the employee is exposed to a contagious disease when such exposure, in the opinion of requests a licensed physician, would render the employee a hazard to the health of others. 7. Pregnancy and/or childbirth and other conditions related thereto. 8. Leave for use of reasonable amounts of male employees may be deducted from sick leave for caring for a member care of the employee's immediate ’s wife and family during the post-natal period. Such sick leave shall not be unreasonably withheld. "Immediate family" means the spouse, same-sex domestic partner, and the grandparents, parents, brothers, sisters, children, and grandchildren of both the employee and the spouse or same-sex domestic partner, and dependents living in the household. 4. The death of for a member of the employee's immediate family, at the discretion of the supervisor. During any seven (7) day period, the maximum number of days of sick leave charged against any employee shall be five (5)) consecutive days. Written requests for this purpose must be submitted to and approved by the Employer. d. An employee who requires the use of sick leave should notify the supervisor as soon as practicable. e. An employee who becomes eligible for the use of sick leave while on approved annual leave shall, upon notifying the supervisor, substitute the use of accrued sick leave to cover such circumstances.

B. Definition of immediate family shall include: brother, sister, spouse, child, mother, father, or loco parentis. One “significant other” may be designated by the employee and may be approved by the Executive Director as “immediate family”' for the purpose of this section. “Significant other,” as used herein, is intended to refer to an individual who stands in lieu of a spouse. Said request for designation may be made to the Director no more than once in a calendar year; the designation must be in effect at least thirty (30) calendar days in advance of any request for leave as set forth herein. C. For purposes of subsection A (2) herein, up to five (5) days sick leave may be granted to the employee who provides proof of attendance at the discretion funeral of: brother, sister, spouse, significant other, child, mother, father, loco parentis, father-in-law, mother-in-law, brother-in-law, sister-in-law, daughter-in-law, son-in-law, grandparents, grandchild or stepparents, stepchildren, step-sibling, legal guardian, or other person who stands in place of a parent as approved by the Director. Funeral leave days must be consecutive work days and include the day of the funeral. Where the day of the funeral is on a day the employee is otherwise not scheduled to work, the consecutive work days will be scheduled with the approval of the supervisor. Approval of requests for use of reasonable amounts of sick leave, in addition to paid Bereavement Leave otherwise provided by this Policy, for the death of a member of the employee's immediate family shall not be unreasonably withheld. c. Uses of Sick Leave. a. Sick Accumulated sick leave shall be accrued before being takenapproved for use by a regular employee for the following reasons: A.
