Common use of Vacation Pay Upon Separation Clause in Contracts

Vacation Pay Upon Separation. Any employee with regular or interim status separating from the City service who has accrued vacation leave shall be entitled to separation pay in lieu of such vacation. When separation is caused by death of any employee, payment shall be made to the estate of such employee or, in applicable cases, as provided by the Probate Code of the State.

Vacation Pay Upon Separation. In case of death of an employee, the unused vacation leave credited to any such employee shall be entitled paid to separation pay in lieu of such vacation. When separation is caused by death of any employee, payment shall be made to the surviving spouse or the estate of such employee or, in applicable cases, as provided by the Probate Code of the Statedeceased if there is no living spouse.
