VACATIONS AND VACATION PAY. 9.01 All employees who are covered under this Agreement shall receive vacation pay as a percent of the employee's total earnings exclusive of the Employer's contribution to the Union's Pension, Health Benefit Plan, Education and Assistance Fund and Industry Fund. Income tax shall be deducted weekly from the employee's earnings increased by the amount of vacation pay. a. Employees shall be granted their vacation periods as requested insofar as it is practical and in accordance with seniority, unless the Employer decides to grant all vacations at one time, in which case the Employer shall give the employees at least six (6) weeks advance notice. 9.03 The Employer agrees to remit the Vacation Pay of each employee as agreed upon in 9.01 of this Agreement and in accordance with the regulation set by the Employment Standards Branch, Ministry of Labour, monthly before, but not later than the fifteenth of the following month to the Union using a separate cheque marked "Vacation Pay", accompanied by a list on which all deductions and contributions as mentioned in 6.01, 13.02, 14.02a, 14.02b, 18.01, 19.01 and Schedule "A" are recorded. 9.04 In accordance with the agreement with the Employment Standards Branch, Ministry of Labour, the Board of Trustees of the Union's Vacation Pay Trust Fund, is obligated to take any steps which may be available to them either in law or in equity or in bankruptcy as may be necessary or desirable to effect collection from delinquent Employers. All costs incurred in the collection of said payment will be charged to such defaulting Employer. 9.05 The Employer agrees to give the auditor of the Union's Trust Fund the privilege to examine the Employer's records concerning hours and monies forwarded to the Union, if and when the auditor so desires. Any date for such an examination will be pre-arranged in writing between the auditor, the Employer and the Union.

An employee who completes five years, ten years, fifteen years, or twenty five years of service as the case may be becomes entitled to an additional week of vacation upon satisfying each of the thresholds to be taken in the calendar year in which the threshold is satisfied. The additional week shall be arranged by mutual agreement between scheduled after entitlement occurs and prior to the Employer and each employee. The Employer shall include in each pay period the appropriate amount of vacation pay in the gross pay for all employees. The employee's cheques shall show the gross pay, and all regular deductions shall be made from the gross amount. VACATIONS AND VACATION PAY. 9.01 All employees who are covered under this Agreement SECTION 16.1 A regular full-time employee, except police dispatchers, is entitled to time off with pay as Vacation, and shall receive Vacation Pay of eight (8) times his regular, straight-time hourly rate of pay for each day of Vacation. SECTION 16.2 A regular full-time employee shall begin to accrue vacation pay as upon the completion of one hundred twenty (120) calendar days of employment with the City at a percent rate of one (1) day of vacation per each sixty days of calendar service up to an employee's first anniversary date of employment or January 1, whichever shall occur first. Thereafter, vacation time shall accrue on a pro-rated monthly basis commencing on January of each year. Vacation time shall accrue based upon the number of years of uninterrupted service which an employee will achieve during the calendar year. After January 1 of each year, an employee may "borrow" against vacation time which will accrue during the year. However, should an employee leave the employ of the employee's total earnings exclusive of the Employer's contribution to the Union's PensionCity at a time when "borrowed" vacation time has not yet been accrued, Health Benefit Plan, Education and Assistance Fund and Industry Fund. SECTION 16.4 While the City prefers that vacation days be taken within the calendar year in which they accrue, employees can, at the end of each calendar year, bank one-half of the number of vacation days accrued in that year. All banked vacation days must be taken in the calendar year subsequent to the year in which they were earned. Should an employee fail to utilize banked vacation days, at the City's option either vacation time will be forfeited and vacation pay will be paid on the last day of the calendar year, or the City may require the employee to take vacation time during the last month of the calendar year. SECTION 16.5 An employee who terminates his employment with the City shall be paid for Vacation earned but unused as of the date of termination on a pro rata basis. Upon termination of employment, vacation time which has been taken but has not yet been earned or accrued shall be deducted from an employee's final paycheck. SECTION 16.6 An employee who is entitled to overtime pay under this agreement may elect compensatory time calculated at the same rate as overtime pay. Up to eighty (80) hours of compensatory time may be banked; once the eighty (80) hour cap is reached, overtime work must be compensated by overtime pay. Employees with accrued compensatory time may request time off (in increments of (1) or more hours), of which shall be requested with at least seventy-two hours advanced notice, except in the case of extreme personal emergency. Requests to use accrued compensatory time may not be unreasonably denied, and may not create overtime in either the Street or Water Departments. Only one bargaining unit employee shall be on a compensatory day off or a paid day off (PDO) per day. Once the employee’s compensatory time bank has been drawn down by the use of compensatory time off, the employee may again elect to receive overtime in the form of compensatory time rather than overtime pay, up to the eighty (80) hour cap. Accrued compensatory time may be carried over from year to year. At the option and election of the employee, all, or any portion thereof, of the amount of vacation pay. a. Upon completion of 10 years 8% 9.02 The Employer will endeavour to grant vacations at the times requested, in the vacation seasons or periods, considering business requirements. 9.03 A vacation list will be posted in the office on May 1st of each year for employees to indicate the time they wish to have. The final list will be posted by June 1st of each year. Any subsequent vacation time will be granted on the basis of work scheduling requirements. All employees shall be granted a minimum of one (1) week during the summer vacation period. Employees wishing two (2) weeks or more may do so by arrangement with the Employer prior to the posting of the vacation schedule. Any conflict will be settled on the basis of seniority. 9.04 When vacations are requested by more employees than can be reasonably scheduled to be away at any one time and still carry on efficient company operations, then the choice of those employees permitted to take their vacation will be, insofar as a percent possible, based on seniority. a. The employee's cheques shall show the gross pay, and all regular deductions shall be made from the gross amount. VACATIONS AND VACATION PAY. 9.01 16.01 Vacation time, Vacation Pay, and vacation scheduling shall be managed in accordance with the schedule found in the Local Appendices. Each facility’s “vacation year” shall be identified in the Local Appendices as either: January 1 to December 31; or July 1 to June 30 16.02 All employees who are covered under this Agreement will be required to take at least two (2) weeks’ vacation annually. If at the third month prior to the end of the vacation year, an employee has not booked her vacation time to occur before the end of the vacation year, the Employer may endeavour to book her vacation time for her. Employees shall be granted their vacation periods as requested insofar as it is practical practicable and in accordance with seniority, unless the Employer decides to grant all vacations at one time, in which case the Employer shall give the employees at least six (6) weeks advance notice. 9.03 10.04 The Employer agrees to remit the Vacation Pay of each employee as agreed upon in 9.01 of this Agreement and in accordance with to the regulation set Union's Employee Trust Fund by the Employment Standards Branch, Ministry of Labour, monthly before, but not no later than the fifteenth of the following month to in which such vacation pay is earned. Vacation Pay shall be remitted together with, and in the Union using a separate cheque marked "Vacation Pay"same manner as union dues, accompanied by a list on which all deductions and contributions as mentioned in 6.01, 13.02, 14.02a, 14.02b, 18.01, 19.01 and Schedule "A" are recordeddescribed at Article 7. 9.04 10.05 In accordance with the agreement with the Employment Standards Branch, Ministry of LabourAct, the Board of Trustees of the Union's Union and its Vacation Pay Trust Fund, is obligated to take any steps which may be available to them it either in law or in equity or in bankruptcy as may be necessary or desirable to effect collection from delinquent Employers. All costs incurred in the collection of said payment will be charged to such defaulting Employer. 9.05 The Employer agrees to give the auditor of the Union's Trust Fund the privilege to examine the Employer's records concerning hours and monies forwarded to the Union, if and when the auditor so desires. Any date for such an examination will be pre-arranged in writing between the auditor, the Employer and the Union.

VACATIONS AND VACATION PAY. 9.01 All employees who are covered under this Agreement a. During the probationary period and periods employed as a student, Employees shall receive accrue vacation pay as a equal to four (4%) percent of the employee's total earnings exclusive of the Employer's contribution to the Union's Pension, Health Benefit Plan, Education and Assistance Fund and Industry Fund. Income tax shall be deducted weekly from the employee's earnings increased by the amount of vacation pay. a. Employees shall, upon hire, receive ten percent (10%) vacation pay, and up to three weeks of vacationtheir gross earnings. b. Employees with ten or more who have completed less than three (3) years of service with the Employer shall be entitled to receive at least two (2) weeks vacation with pay equal to eight (8%) percent of their annual gross earnings. c. Employees who have completed three (3) years of service, but less than six (6) years with the Employer, shall be entitled to receive at least three (3) weeks vacation with pay equal to ten (10%) per cent of their annual gross earnings. d. Employees who have completed six (6) years of service or more with the Employer shall be entitled to receive at least four (4) weeks vacation with pay equal to twelve percent (12%) vacation pay, and up to four weeks per cent of vacationtheir annual gross earnings. 9.02 Vacation periods 10.02 The Employer shall be arranged by mutual agreement between the Employer and each employee. Employees shall be granted their vacation periods as requested insofar as it is practical and in accordance with seniority, unless the Employer decides endeavour to grant all vacations at a maximum of one time, in which case week of vacation during the Employer shall give summer period to those employees who so request. The summer period is defined as July 1 – Labour Day. 10.03 Approval of vacation time is subject to the employees at least following conditions: a. Vacation requests received six (6) weeks months or more in advance noticeof the requested vacation date will be approved in order of seniority. Vacation requests received with less than six (6) months of notice will be scheduled on a “first come, first served” basis. 9.03 b. All requests for vacation time shall be made in writing to the Employer’s office or on a vacation schedule posted by the Employer. c. Approval of vacation time is subject to operational requirements but shall not be unreasonably denied. a. The vacation pay for all probationary employees and students shall be paid directly to the employee in each pay period. b.
