Vendors and Subcontractors. CONA may use Vendors and Subcontractors to provide Services on its behalf in accordance with the terms of this Master Agreement. Any such Vendor or Subcontractor will be permitted to process Personal Information solely pursuant to the terms of this Article 8 and only as necessary to deliver the services CONA has retained them to provide. These Vendors and Subcontractors may be located outside of the United States. CONA warrants that the agreements it has in place with any and all Vendors and Subcontractors contain similar or greater data privacy and security obligations.
Vendors and Subcontractors. Contractor shall, for the protection of Contractor and Company, obtain from the Vendors and Subcontractors such guarantees and warranties with respect to Work performed and Equipment supplied, used and installed hereunder as are reasonably obtainable, which guarantees and warranties shall equal or exceed those set forth in Section 12.1 and shall be made available and assignable to Company to the full extent of the terms thereof upon the expiration of Contractor’s warranty hereunder. Company shall be an express third-party beneficiary of all such guarantees and warranties, provided such third-party beneficiary rights shall not be effective unless this Agreement has been terminated. To the extent available, Company shall have the right to require Contractor to secure additional warranty or extended guarantee protection pursuant to a Change Order issued in accordance with the provisions of Article VI. Upon the earlier of the Substantial Completion Date or termination of this Agreement, Contractor shall deliver to Company copies of all relevant contracts providing for such guarantees and warranties.

Without otherwise negating Contractor’s responsibilities under this Article XII, Contractor shall, for the protection of Contractor and Owner, obtain from the Vendors and Subcontractors such guarantees and warranties with respect to Work performed and Equipment supplied, used and installed hereunder as are reasonably obtainable, which guarantees and warranties shall, if commercially practicable, equal or exceed those set forth in Section 12.01 and shall be made available and assignable to Owner and the Financing Parties to the full extent of the terms thereof. Owner shall have the right to require Contractor to secure additional warranty or extended guarantee protection pursuant to a Change Order issued in accordance with the provisions of Article VII to the extent reasonably available. Upon the earlier of the Final Acceptance Date or termination of this Agreement, Contractor shall deliver to Owner copies of all relevant unpriced contracts providing for such guarantees and warranties.

Supplier shall not (i) change the vendors from whom Supplier sources components of the Products as of the Effective Date or (ii) subcontract its obligations to manufacture Products to subcontractors in each case without the prior written consent of SI-BONE; [*] = Certain confidential information contained in this document, marked by brackets, has been omitted and filed separately with the Securities and Exchange Commission pursuant to Rule 406 of the Securities Act of 1933, as amended. provided, that SI-BONE hereby acknowledges its consent to Supplier’s purchase of Product components from vendors identified in Exhibit B (“Approved Vendors”) and use of subcontractors identified in Exhibit C (“Approved Subcontractors”). SI-BONE may order through Supplier components sourced from Supplier’s approved vendors (which vendors may include affiliates of SI-BONE) and Supplier agrees to provide those components to SI-BONE at Supplier’s cost [*]. Subject to the requirements of Section 4.7 of this Agreement, SI-BONE may request or otherwise require Supplier to approve and utilize alternative sources including the Approved Vendors and Approved Subcontractors.
Vendors and Subcontractors. 1. Subcontractors are those entities named within the Grant Agreement’s Accomplishment Plan. All subcontractors are required to complete the L-SOHC subcontract agreement. A separate addendum is required for subcontractors that purchase land. Grantee specifications, contracting forms or other documents may be attached to the L-SOHC subcontract form as addendums. Where a conflict in language occurs, the L-SOHC subcontract form and/or addendum shall prevail.
Vendors and Subcontractors. AVT Connect may provide all or part of the Services through its vendors, affiliates or subcontractors.

FPL shall be an express third party beneficiary of all such guarantees and warranties. All such warranties obtained shall be in addition to, and shall not alter the warranties of, Contractor. Upon FPL’s request, Contractor shall use all reasonable efforts to force Subcontractors to honor warranties including, but not limited to, filing suit to enforce same. To the extent available, FPL shall have the right to require Contractor to secure additional warranty or extended guarantee protection pursuant to a Change Order issued in accordance with the provisions of Article VI, CHANGE ORDERS. Upon the earlier of the Provisional Acceptance Date or termination of this Agreement, Contractor shall deliver to FPL copies of all relevant contracts providing for such guarantees and warranties.

Owner shall be an express third party beneficiary of all such guarantees and warranties. All such warranties obtained shall be in addition to, and shall not alter the warranties of, Contractor. Upon Owner’s request, Contractor shall use all reasonable efforts to assist Owner in enforcing the warranties. To the extent available, Owner shall have the right to require Contractor to secure additional warranty or extended guarantee protection pursuant to a Change Order issued in accordance with the provisions of ARTICLE 6. Upon the earlier of the Final Acceptance Date or termination of this Agreement, Contractor shall deliver to Owner copies of all relevant contracts providing for such guarantees and warranties. In the case of warranties from the manufacturers of the solar modules, the racking and tracking system and the inverters, the Vendors will acknowledge to Owner in writing prior to the Final Acceptance Date that their equipment has been properly installed and that their warranty is fully in effect on an “as built” or “as installed” basis and will remain in effect on the same basis when assigned by Contractor to Owner.
Vendors and Subcontractors. Except as otherwise provided herein, Contractor shall, for the protection of Contractor and Owner, obtain from the Vendors and Subcontractors such guarantees and warranties with respect to Work performed and Equipment used and installed under this Contract as are reasonably obtainable, which guarantees and warranties shall equal or exceed those named in Article 11.1 or Article 11.2 above and shall be made available and assignable to Owner to the full extent of the terms thereof. Such guarantees and warranties shall extend for a period of at least one year after the Commercial Operation Date. In addition, if more complete warranty or guarantee protection is available than as set forth above with respect to the turbine generator or any other principal Equipment, Contractor shall notify Owner of the availability of such additional protection and of the cost thereof, and Owner shall have the right to require Contractor to secure such additional warranty or guarantee protection pursuant to a Change Order issued in accordance with the provisions of Article 6 above. Upon the earlier of the Final Acceptance Date or termination of this Contract, Contractor shall deliver to Owner copies of all relevant contracts providing for the guarantees and warranties.
