Common use of Violence Prevention and Control Clause in Contracts

Violence Prevention and Control. The Health Centre and the Union agree that no form of verbal, physical, sexual, racial or other abuse of employees will be condoned in the workplace. (a) The Health Centre in consultation with the joint health and safety committee shall develop, establish and put into effect, violence prevention and control measures, procedures, practices, equipment and training for the health and safety of workers. (b) The Health Centre will make available training on violence prevention and control measures, procedures, practices and equipment to all employees during a new employee’s orientation and at least annually thereafter. (c) The Employer will notify the Joint Health and Safety Committee (JHSC) and Union in writing of all incidents related to violence within four (4) days. For critical injuries the Employer will notify the JHSC and the Union immediately and in writing within 48 hours. Such notices will contain all of the information as prescribed in Section 5 of the Health Care Regulation. (d) Immediate critical incident stress debriefing and post traumatic counselling shall be made available for employees following a critical incident involving violence. Leave required to attend such debriefing or counselling will be without loss of pay. (e) The Health Centre will consider requests for reimbursement for damages incurred to the employee’s personal property, such as eyeglasses, ripped uniforms, personal clothing as result of being assaulted while performing his/her work. Such payment shall not be unreasonably denied.
