Voluntary Sick Leave Bank. 1. The purpose of the Voluntary Sick Leave Bank is to provide extended sick leave coverage to any employee benefited by this agreement who has exhausted his/her sick leave and who is a member of the Voluntary Sick Leave Bank pursuant to Paragraph B. below. An employee may access the Voluntary Sick Leave Bank for absences due to or resulting from an extended and/or serious injury, illness or disability as defined by the Family and Medical leave Act as a serious personal illness or injury. 2. To be eligible to join the Voluntary Sick Leave Bank as a member, an employee must have completed one (1) year of employment and must contribute one (1) day of his/her accumulated sick leave to the Bank. 3. The Bank will be administered by a committee of four persons, two members representing the Department and two members representing the Association, to be known as the Sick Leave Bank Committee. 4. All requests for the use of sick days from the Voluntary Sick Leave Bank shall be directed to the Sick Leave Bank Committee. The Sick Leave Bank Committee may approve a request for the use of Voluntary Sick Leave Bank days in an amount up to ninety (90) days. The total grant of Voluntary Sick Leave Bank days shall not exceed 1 (one) year per illness, injury or disability. A request for the use of Voluntary Sick Leave Bank Days must be accompanied by an application and medical documentation. Any requests for an extension of Voluntary Sick Leave Bank benefits of more than ninety (90) days, must be accompanied by a new application and current medical documentation. 5. In acting upon requests for sick days from the Voluntary Sick Leave Bank, the Sick Leave Bank Committee shall utilize the following criteria: A. adequate medical evidence; B. Prior utilization of sick leave and/or Voluntary Sick Leave Bank C. reason for and propriety of prior use of sick leave; and D. the member’s intent to return to service in the Ayer Police Department 6. In order for a member to be eligible for Voluntary Sick Leave Bank benefits in each fiscal year, he/she must return to work for a period of time at lease as long as the period for which he/she received benefits. The Sick Leave Bank Committee may waive this provision in extraordinary circumstances. 7. The decisions of the Sick Leave Bank Committee are final and not subject to the Grievance and Arbitration Procedure. 8. Implementation open.

No one may join at a later date. Only employees who have donated at least one day to the Voluntary Sick Leave Bank are eligible to be the recipient. The issuance of days will be completed through the use of a lottery. Those individuals who donate a day(s) will have their name placed in the lottery pool. A name will be drawn out and that individual will have a sick leave day deducted from his/her total accumulated days. Those individuals who donate more than one day will not be placed back in the drawing until all individuals who donated days have been drawn out at least once. Then the names of those who have donated more than one day will be placed back in the pool. The days will be used on an as- needed basis. At the close of the school year, unused days will be credited back to the donor. Individual names in the drawing will be confidential. The individual will not know who or how many days were donated. If the number of days in the Bank falls below ten (10), the Association President will be notified in writing and current participants may donate additional days to the Bank. If a person chooses not to donate again, he/she is no longer an eligible recipient. In the event that all available days have been used, withdrawing days from the Sick Leave Bank Committee shall utilize is no longer an option. The maximum number of days available to any eligible employee through the Bank will be the number of days needed to complete the current school year. An individual unable to start the following criteria: A. adequate medical evidence; B. Voluntary Sick Leave Bank. 1a. The District shall maintain a Voluntary Sick Leave Bank (VSLB) for use by a Teacher to care of his/her own personal serious illness or disability, or for the care of a Teacher’s family due to such family member’s serious illness or serious disability. The purpose For purposes of the Voluntary Sick Leave Bank, the Teacher’s “family” shall be defined to include: parents, spouse, children, or domestic partner. In addition, the immediate family, for purposes of this section, shall include: spouse, children, parents, parents- in-law, brothers, sisters, grandparents, grandchildren, brothers-in-law, sisters-in-law, sons-in-law, daughters-in-law, aunts and uncles living in the Teacher’s household and legal guardians and wards. “Serious illness or disability” shall be defined as that which jeopardizes the life of the family member or a medical emergency which confronts the family member. b. A Committee will be formed which shall consist of two (2) Administrators chosen by the District and two (2) Teachers chosen by the Association.
