Warranty and Inspection. Compliance: Failure to comply with any of these terms and conditions shall be considered sufficient reason for refusal to accept delivery of the goods.

Warranty and Inspection. Seller warrants that all goods shall: conform to the specifications, drawings, samples or other description agreed to by Seller and Buyer; meet the highest industry standards for merchantability and workmanship; be free from all defects; and comply with all applicable laws and regulations. Such warranties shall survive Buyer’s inspections, tests and acceptance for a period, the later of: (i) twelve (12) months from the date of Buyer’s installation or use of the goods or (ii) eighteen (18) months from the date of Buyer’s acceptance of the goods. If any goods delivered are defective or otherwise not in conformity with the requirements of this Purchase Order, Buyer, in addition to its other rights including the right to recover direct, consequential, incidental or exemplary damages (including business and economic losses), attorney’s fees and costs, may reject the same for full credit or require proper correction, replacement or completion thereof at Seller’s expense. All rejected goods may either be returned to Seller at Seller’s expense, or may be held by Buyer for disposition at Seller’s risk and expense. Seller shall at all reasonable times permit inspection and testing by Buyer of all items, work in process, materials and workmanship covered by this Purchase Order.

In addition to the warranties provided for under the Uniform Commercial Code, Subcontractor warrants that all goods furnished under this Agreement will be free from defects, will conform with all requirements of this Order, and, unless manufactured solely in accordance with Triad certified manufacturing designs, will be free from defects in design. Any goods corrected or replaced will be covered by this warranty. Subcontractor agrees to notify Xxxxx’s Procurement Specialist immediately upon becoming aware of a potential problem with goods previously delivered to Triad. Nonconforming goods will be replaced or corrected at Subcontractor's expense.
Warranty and Inspection. Contractor guarantees that all labor and materials provided for the Work will be of first quality, in full compliance with the requirements of the Contract Documents, and free from defects for a period of 18 months from the Completion Date. If any aspect of this warranty is breached, Contractor shall promptly repair or replace the offending materials, services or labor or pay PCA its cost and expense in conducting that repair and replacement. Contractor warrants any replacement equipment and materials for 18 months after the date of installation. Contractor warrants that none of the equipment or materials to be supplied under this Agreement contains asbestos or asbestos containing materials or, if those items do contain asbestos, Contractor shall advise PCA in writing of the equipment or material containing the asbestos. PCA shall then advise Contractor in writing whether that equipment or material will be acceptable. Contractor further warrants and represents that the Work will not infringe, directly or indirectly, upon any patent, copyright, trademark or proprietary information right. PCA may, at all times during the performance of the Work, conduct such tests and inspections as it deems necessary to assure Contractor’s compliance with the Contract Documents. If any Work or materials are found not to be in compliance with the Contract Documents, PCA may order such Work redone in conformance with the Contract Documents and the materials removed from the job site and replaced with materials conforming to the Contract Documents. No payment by PCA of any sums due under the Contract Documents may be interpreted as a waiver of any defect in the Work.

Warranty and Inspection. Contractor represents and warrants that it has the necessary knowledge, experience, abilities, skills and resources to perform its obligations under this Agreement, and agrees to perform its obligations under this Agreement in a professional manner, consistent with prevailing industry standards and practices. Contractor further warrants that all Work performed under this Agreement shall comply with any and all laws, ordinances, and regulations of any and all governmental agencies entitled to impose such laws, ordinances and regulations. All Work performed by Contractor shall be subject to Viejas’ inspection before acceptance, and payment for Work rendered shall not constitute a waiver of any of the rights granted to Viejas under this section. Contractor warrants that all labor, workmanship and material provided will comply with the requirements of this Agreement and will be free of defects for a period of five (5) years. Contractor will supply labor and materials to correct any defective condition without additional cost to Viejas during the five (5) year warranty period.
