Warranty and Product Liability Matters a) Section 3.26(a) of the Company Disclosure Schedule sets forth (i) a list of all product liability claims made against the Company or any of the Company Subsidiaries since January 1, 2007, and (ii) a summary of warranty claims made against the Company or any of the Company Subsidiaries, together with the annual cost associated with such warranty claims, for each of the three (3) immediately-preceding fiscal years.
b) Except as set forth in Section 3.26(b) of the Company Disclosure Schedule, none of the Company’s or the Company Subsidiaries’ products have design, manufacturing or other defects, and such products comply with, and meet, in all material respects, the current standards of, all Laws dealing with such products. No claims, including, but not limited to, product or service warranty, Liability, strict liability or negligence claims, in respect of the Company’s or any Company Subsidiary’s products or services are pending or threatened.
c) The Company and each Company Subsidiary has used reasonable commercial efforts to limit Liability for warranty and product liability claims.

Warranty and Product Liability Matters. Except as set forth on Schedule 5.21 of the Disclosure Schedules and except to the extent that any loss therefrom would not exceed any general or specific reserves established by Wireless in its Financial Statements, (1) the products and services currently being provided to the marketplace by Wireless are in material compliance with and meet in all material respects all express and implied warranties and the requirements and standards of all Laws applicable to the sale or provision of such products and services and (2) there are no pending nor, to the knowledge of Wireless, threatened product or service warranty or liability claims in respect of products or services sold or provided by it, which individually or in the aggregate would reasonably be expected to have a Wireless Material Adverse Effect.
Warranty and Product Liability Matters. Schedule 3.20 sets forth all written warranties currently provided by Company on any of its products. No product liability or warranty claims, other than claims in the Ordinary Course of Business, consistent in amount and number with those made in prior periods, which are set forth on Schedule 3.20, are pending or, to the knowledge of Company or the Shareholders, threatened, nor is there any reasonable basis for any such claim.

The products and services provided by Company are in compliance with and meet all legal requirements and other requirements and Company has either disclaimed or complied with any express or implied warranty it makes with respect to its products and services, including without limitation any express warranty or any implied warranty of merchantability or of fitness for any particular purpose.
