Water and Sewer Services. The parties to this Agreement acknowledge that the Town has no obligation under this Agreement to provide water and sewer service to the Property. The District will provide water and sewer services to the Property if the Property Owner satisfies all requirements of the District, including, but not limited to, the dedication of water resources and/or the payment of fees in lieu thereof, and the construction of water, sewer and wastewater treatment lines and facilities necessary to service the land use proposed for the Property.
Water and Sewer Services. 8.1. The Owner shall install and connect water and sanitary sewers services, as shown on the Approved Site Plan. Said connections to be at the expense of the Owner, subject to the required fees.
Water and Sewer Services. Manitoba's existing water and sewer program for Northern Manitoba contemplates a basic level of service which shall be implemented, based on the following considerations:
Water and Sewer Services. 6.1 During the Term, the District will provide the following water and sewer services to the Reserve in accordance with the terms and conditions in this Agreement:
Water and Sewer Services. Seller represents and warrants that water and sewer services shall be furnished by the Cxxxxxx County Department of Public Works or such other legal entity responsible for furnishing water and sewer services and such services shall be available to Purchaser for each dwelling unit, as and when required by Purchaser, in accordance with the rates, rules and regulations then in effect. The Purchaser agrees to notify the Builder(s) that at the time of any application for a building permit for said lot or lots, he will agree in writing that he understands that the Certificate of Use and Occupancy will not be issued for said lot or lots until such time as the water and sewer facilities are determined by the County to be substantially complete and that he will include in any contract of sale which he executes for the sale of said lot or lots a written notice to any subsequent purchaser that a Certificate of Use and Occupancy will not be issued for said lot or lots until the water and sewer facilities are determined by the County to be substantially complete. The builder also understands that a Certificate of Use and Occupancy will not be issued for any lot until it is determined by the County that all roads serving the particular lot are substantially complete. Satisfactory installation of the base coat constitutes "substantially complete".
Water and Sewer Services c. The parties to this Third Amendment acknowledge that the Town has no obligation under this Third Amendment to provide water and sewer service to the Village III Property. The Property Owner represents to the Town that Compark Business Campus Metropolitan District, Stonegate Village Metropolitan District, or other provider by contract with the Compark Business Campus Metropolitan District will provide water and sewer services to the Village III Property (the “Water and Sewer Provider”). The Property Owner further represents to the Town that the Property Owner will satisfy all requirements of the Water and Sewer Provider, including, but not limited to, the dedication of water resources and/or the payment of fees in lieu thereof, and the construction of water, sewer and wastewater treatment lines and facilities necessary to service the land use proposed for the Village III Property. The Property Owner acknowledges and agrees that the Town has no obligation to approve any final plats (including replats) or issue any permits, including grading permits, for the Village III Property, until the Town receives written verification that the Water and Sewer Provider will serve the land use proposed for the Village III Property.
Water and Sewer Services. The Operator (or the COUNTY if there is no Operator) shall be responsible for ordering and connecting to potable central water and sewer services, and payment of any associated expenses. CITY will waive utility tap-in fees.
Water and Sewer Services. The City covenants and agrees, at its sole cost, to extend water and sewer infrastructure to the boundary of the Addition, at a location to be determined by the City, sufficient to allow the Property to be utilized by VRC for its intended purposes as set forth in this Agreement. All permitting and inspection fees associated with the water and sewer construction will be waived by the City; however, VRC must still apply for and obtain needed permits for the extension of water and sewer infrastructure to the boundary of the Property.
Water and Sewer Services. Failure of the City to provide water and sewer services in accordance with Agreement or at law; provided, however, that (i) VRC shall be entitled to receive from City any Program Loan Payment due VRC through the date of termination and (ii) the City and VRC agree to negotiate in good faith a remedy that preserves the intent of the parties hereunder as much as reasonably possible including, without limitation, the creation of an interest and sinking fluid.
Water and Sewer Services. The City water and sewer service to property, to include any irrigation water supply.
