Work Schedule. The Employer shall post a work schedule for a one (1) week period in advance in ink for all employees, showing their surname and first initial, not later than 1 p.m. on the Wednesday preceding the first (1st) day of the following workweek. D. Where there is a conflict between subsection (b) and (c) and Section 2 and 4 of this article as it pertains to meal periods, subsection (b) and (c) will prevail.
E. An employee who occupies a position as a Boiler Operator or Food Service Coordinator shall be required to work an eight (8) hour shift without an unpaid meal period.
1. Corrections Professionals who do not bid shifts and days off may request in writing a flexible work schedule and must be agreed upon in advance by the supervisor. A flexible work schedule is a schedule which may vary the number of hours worked on a daily basis and the sequencing of these hours but does not exceed forty (40) hours in a workweek.
2. Overtime for employees working a flexible work schedule is time in excess of forty (40) hours in a workweek and supersedes Article 7- D-3 will apply12 Section 2(A) of this Agreement as it pertains to the Agency’s overtime pay obligation.)
3. Flex time is for infrequent, irregular use for family/personal events. Flex time must take place during the same workweek. Approval of the flexible work schedule is at the discretion of Agency management.

Part-time employees will be required to renew their application for full-time employment annually.
11.05 In scheduling or calling in part-time employees for work, the Company agrees to recognize length of continuous service of the employee on an individual store basis, providing qualifications as to fitness and ability to perform the work are equal. A schedule showing the part-time employees' hours of work for the following week will be posted by 12:00 noon on Thursday for the following week, and a copy of the schedule will be given to the Store Xxxxxxx.
11.06 Part-time employees, "regular", defined for scheduling purposes as those employees who were hired prior to October 31, 2005, will be scheduled for a minimum of twenty-four (24) hours per week provided:
(a) such instancesschedule of hours are available
(b) the employee has the ability to perform the normal requirements of the work available. Where the schedule of hours is such that all "regular" part-time employees, who desire to work their minimum number of hours, as outlined above, are not able to do so, the minimum schedules will be allocated in order of seniority. The employees who, as a result do not obtain the minimum schedule, as outlined above, will be scheduled in order of seniority for the maximum number of hours available. A part-time employee who elects not to accept the minimum schedule of hours per week, as outlined above, will be locked into such decision for a period of not less than three (3) months, and any change in decision to be effective after the completion of three (3) months will require the employee in question to notify the Store Manager in writing four (4) weeks in advance of the schedule being changed. Remaining available hours will be scheduled for part time employees taking into consideration their length of continuous service, and the employee's ability to perform the normal requirements of the work.
11.07 Such posting does not constitute a guarantee of work for that week. If part-time employees are scheduled to report for work and work is not available, they will be notified at least two (2) hours or as soon as possible in advance of their scheduled starting time not to report to work.
11.08 The Company has the right to call in part time employees not scheduled to work that day if required by the business. In the application of this Clause, the additional hours will be offered to employees, in accordance with their seniority and qualifications, only if the hours will not give the “regular” employees as defined in Article 7- D-3 11.06 in excess of twenty-four (24) hours in that week (fifteen (15) hours for all other employees).
(a) Part-time employees relieving full-time employees who are on vacation will applynot be considered as full-time employees for the purpose of this Agreement.)
(b) A part-time employee relieving a full-time employee absent due to illness, accident, or leave of absence will not be considered full-time for the purpose of this Agreement.
11.10 Part-time employees will normally be available for two (2) shifts and Saturday each week. Secondly, employees will be scheduled rotating start times when working on either day shifts or evening shifts. If employees limit their availability contrary to the foregoing, they may not receive their minimum hours as set out in Articles 11.06 and 11.08.

Work Schedule. The Employer and the Union agree that all regular, part-time employees will be scheduled for available hours of work and where skill and ability are relatively equal, length of continuous service shall apply. A regular, part-time employee who reports to work shall receive the minimum of three (3) hours pay, except when the employee is notified in advance by the Employer, that will be required to work less than three (3) hours on that shift. Extra shifts will be awarded by seniority providing such factors as qualifications, competence and efficiency are considered equal by the Hospital. After the eighteenth (18th) of the month, per diem employees will be assigned to vacant positions on the schedule. Once per diem employees have been slotted onto the schedule, regular staff will not have preference for those scheduled or additional hours within 24 hours of the start of shift to be covered (outside of the 24-hour window the Hospital may use part time, non overtime regular staff). Exchange of shifts shall not result in overtime payments. Such exchange of shifts shall fall within the pay period or as otherwise approved by the Employer. For the Christmas holiday season (2 pay periods to be identified by the employer before December) employees may request to giveaway shifts with the consent of their Supervisor/Designate. Such giveaways will not be unreasonably denied. Requests must be submitted in writing, on the appropriate form, and co-signed by the Supervisor/Designate and employees requesting the giveaway and additional shift. Giveaway/additional shifts shall not result in overtime payments.

Work Schedule.
(a) The Employer following regulations shall post govern the scheduling of hours of employees in the bargaining unit. Shift schedules shall be arranged as follows:
(i) No Employee shall be scheduled to work more than six (6) consecutive days;
(ii) Full Time Employees shall receive a work schedule minimum of every other weekend off. This scheduling provision does not apply when employees mutually agree to exchange shifts or when an employee accepts or requests a shift at her own discretion.

Work Schedule.
A. The Employer appointing authority shall post fix the hours of work with due regard for the convenience of the public, the laws of the State and the County, and as best serves the County.
B. The County agrees to assign employees to a regular work schedule; the County may change that schedule at its discretion. The County agrees to give employees a minimum of an eight (8) working day advance notice of work schedule changes unless otherwise agreed to by the affected employees. The classification of Correctional Officer is not limited to the normal seven (7) day work period of the Fair Labor Standards Act (FLSA) pursuant to 29 U.S.C. Section 207(k) of the FLSA. At the discretion of the Sheriff or his/her designee, based on available staffing, employees may be assigned to a work schedule for consisting of eighty (80) hours in a one fourteen (1) week period in advance in ink for all employees, showing their surname and first initial, not later than 1 p.m. on the Wednesday preceding the first (1st14) day FLSA work period. For employees in such work schedules, overtime shall be defined as any authorized time worked beyond eighty (80) hours per biweekly pay period. The definition of "time worked" shall be as defined in the MOU.
C. Employees shall be allowed rest periods of fifteen (15) minutes during each half shift. Such rest periods shall be scheduled in accordance with the requirements of the following workweekindividual department but shall generally occur near the middle of each four-hour shift. The Rest periods are not cumulative and if not taken during the four hours shift are lost. Rest periods if not taken, are lost and may not be accumulated to extend lunch hours or to shorten the work day. Neither shall any additional pay accrue to an employee who misses or loses a rest period.
D. In no case may an employee's work schedule shall not be changed after postingduring the work week when the purpose of such change is to avoid overtime compensation, except as provide for belowunless written notice has been provided to the employee and is agreed to by the employee.
E. Effective October 2014, shift assignments shall be subject to seniority bidding during the months of April, and October. An If an employee is on restricted duty status (transitional work agreement, limited duty, etc.) at the time shift bidding takes place and has documentation indicating he/she will no longer continue restricted duty status at actual shift change, the employee shall be guaranteed pay for the specific days in a workweek upon which the employee is scheduled allowed to work, provided the employee is available for such work, subject to Article 6-E of this Agreement. 4. When an individual’s shift needs to change, because that individual employee is attending jail operations courses;
5. When the specific assignment of this Paragraph individuals would negatively affect the proper operation of the jail; or
6. In order to comply with the provisions of the Americans with Disabilities Act (ADA). This provision cannot be used for punitive purposes.
F. For purposes of shift sign-up, seniority of Correctional Officer I and II will be defined as the date of initial appointment as a regular Correctional Officer with El Dorado County. If an employee resigns and is subsequently reemployed under provisions of Article 5, Section 3, Salary Status Upon Reemployment, seniority for purposes of shift sign-up shall be paid at the rate date of time and one-half (1½). The Employer shall endeavor reemployment.
G. Provided advanced approval is obtained from the appropriate supervisor, line staff will be permitted to rotate all clerks on night and Sunday worktemporarily exchange shift assignments for educational commitments which meet the requirements in Article 7, except where such rotation adversely affects the Employer’s operation, and provided such rotation is agreeable to the employee. Work Schedule. The It is agreed the Employer shall post a work schedule in a conspicuous place, in ink, in each store, on Thursday morning of each work week but not later than 12:00 noon, for the following week for all employees.
(a) All employees listed on the schedule will be provided the work or pay for the hours posted; provided they report to work as scheduled.
(b) Each schedule shall show the first and last name of each employee, starting time, meal period, quitting time and days off, and in the order of seniority - provided the Employer’s scheduling system can accommodate such ordering. The parties agree that the use of electronic scheduling will not interfere with or reduce hours employees are entitled to under the CBA. Where any work schedule is modified, the Company shall repost a paper version of the modified schedule in the appropriate store by 8 a.m. the next day.
(c) Once the work schedule is posted, both the Employer and the employees covered by this Agreement agree that, if it becomes necessary to change the work schedule for reasons beyond the control of either, as much advance notice as is possible shall be given. Both parties agree to personally notify the other of the inability to work the schedule. Employees must notify the store manager or person in charge of this inability.
(d) If the work schedule is not posted in accordance with the terms of this Agreement, on the first violation, the Personnel Director shall be notified. If there is a second violation of this provision, the Personnel Director shall be notified. If there are any further occurrences of a violation of this provision, each employee listed on the work schedule for the department of the violation shall be paid one hour of penalty pay. Should there be no violations for one year, the process shall begin again.
(e) Any employee who fails to report for work on a scheduled work day must provide the Store Manager or manager-in-charge with sufficient reason to have prevented the employee from reporting to work or they may be considered a no call/ no show and suspended for five days and shall be given a written corrective action notice. An employee will be considered to be a no call/no show if they fail to call the manager-in- charge at the store or show up to work prior to the end of their scheduled shift. If the employee repeats the infraction within two years, the employee may be terminated. If an employee fails to call to notify management that he or she is going to be late or fails to report to work within one hour following their scheduled starting time, the employee will forfeit the shift and the Company may then call in another employee.
(f) It is understood that circumstances may require the management to change or alter schedules during the work week in case of emergency (emergency shall be defined as fire, strike, flood, illness, funeral leave, or act of God). In case of emergency as defined, the Employer shall notify affected employees of schedule changes immediately. In such cases, the Employer shall use its best efforts to assure a full-time employee of his or her forty (40) hours pay, provided he or she works the altered schedule. Part-time employees will be assured a minimum of four (4) hours pay each day of an altered schedule, provided he or she works the altered schedule. Schedules for part-time and courtesy clerks shall not be altered to deliberately reduce the original posted hours of work.
(g) Part time employees who are to be scheduled more than five (5) days in a workweek will be given notification of such schedule forty-eight (48) hours prior to the posting of the schedule. Such employee must indicate in writing within twenty-four (24) hours of such notification a request not to work in excess of five (5) days a week. This request will be honored and can only be revoked by a written request submitted by the employee one (1) week period in advance in ink for all employees, showing their surname and first initial, not later than 1 p.m. on the Wednesday preceding the first (1st) day of the following workweek. The work schedule shall not be changed after posting, except as provide for below. An employee shall be guaranteed pay for posting of the specific days in a workweek upon which the employee is scheduled to work, provided the employee is available for such work, subject to Article 6-E of this Agreement. The schedule may be changed after 1 p.m. on Wednesday but no later than 1 p.m. on Thursday to accommodate an employee returning from leave of absence. The schedule may also be changed with the Union’s agreement in response to a grievance filed pursuant to Article 6(D)(3)(gnext schedule.

Work Schedule. In establishing an employee's work schedule, NEA and the Union recognize that the accomplishment of NEA's work comes first. Achievement of the highest quality product and service and meeting the needs of NEA's clients and affiliates are the primary objectives when considering work schedules. The Employer parties further recognize that the employees play an integral part in fulfilling the mission of NEA in a cooperative, collaborative work environment and that individual job satisfaction is important to ensuring effective performance. It is in this context that the provisions set forth below are to be viewed.
Section 1. Workday
(a) The normal business hours of NEA shall post begin at 8:15 a.m. and shall end at 6:00 p.m. Except as otherwise provided in Section 2, the normal workday of an employee shall consist of seven and one-half consecutive working hours within NEA's normal business hours, except for a forty-five (45)-minute unpaid lunch break. Prior to NEA finalizing an employee's daily work schedule, reasonable effort will be made to harmonize the employee's preference with the needs of NEA, but NEA reserves the right to make the final determination in this regard. An employee will work a daily schedule established within these parameters; however, an immediate supervisor may temporarily adjust an employee's daily schedule to accommodate unusual circumstances.
(b) Subsection (a) above notwithstanding, when NEA deems it necessary to alter employees' schedules in order to improve its services to affiliates or to meet work deadlines, NEA may schedule employees to begin work before 8:15 a.m. or after 9:45 a.m. as follows:
(i) NEA may set the regular schedule of such employees to begin no earlier than 7:00 a.m. and to end no later than 8:30 p.m.
(ii) Whenever NEA sets such a schedule, it shall first attempt to locate qualified volunteer employees to work the schedule.
(iii) If sufficient employees do not volunteer, NEA shall establish a rotational schedule with each employee working the schedule for not less than two (2) weeks, and not more than six (6) weeks, at a time.
(iv) Except when unforeseen circumstances make such notice not practicable, NEA shall give all affected employees twenty (20) days' notice of any schedule established pursuant to this subsection.
(v) Employees scheduled to begin work prior to 8:15 a.m. or to end work after 6:00 p.m. pursuant to this subsection, shall be paid a premium of six percent (6%) of his/her hourly rate for all regularly scheduled hours worked between 6:00 p.m. and 8:15 a.m.
(c) The immediate supervisor may approve an employee's request to extend his/her work schedule before or after NEA's normal business hours.
(d) The workday schedule of an employee in a new position or of an employee who is transferred, reassigned, or placed in a different or changed position, shall be established consistent with the provisions of subsection (a) above.
(e) In addition to the schedules established pursuant to Section 1(b), NEA reserves the right to schedule up to three (3) seven-and- one-half (7.5) hour shifts per twenty-four (24)-hour period for the service functions (i.e., printing, mailing and data processing) and to establish the starting times for such shifts, provided that such an employee shall receive a shift premium of six percent (6%) of his/her regular hourly rate for those hours scheduled and worked between 6:00 p.m. and 8:15 a.m.
(f) An employee shall be permitted two (2) paid fifteen (15)-minute rest periods each day, in addition to his/her forty-five (45)-minute unpaid lunch break. An effort shall be made to schedule the rest periods at a mutually agreeable time, but NEA reserves the right to make the final determination in this regard. With the concurrence of his/her supervisor, an employee may schedule one (1) week period of these rest periods in advance in ink for all employees, showing their surname and first initial, not later than 1 p.m. on order to extend the Wednesday preceding the first (1st) day of the following workweek. The work schedule shall not be changed after posting, except as provide for belowlunch break to one hour. An employee shall be guaranteed pay for permitted time off as necessary to use the specific days in a workweek upon which the employee is scheduled to work, provided the employee is available for such work, subject to Article 6-E of this Agreement. The schedule may be changed after 1 p.m. on Wednesday but no later than 1 p.m. on Thursday to accommodate an employee returning from leave of absence. The schedule may also be changed with the Union’s agreement in response to a grievance filed pursuant to Article 6(D)(3)(g) or Article 6(F)(3). (c) Employees may request to exchange shifts with the consent of their Supervisor/Designate. Such exchanges will not be unreasonably denied. Requests must be submitted in writing, on the appropriate form, and co-signed by the Supervisor/Designate and employees requesting the exchange. Exchange of shifts shall not result in overtime payments. Such exchange of shifts shall fall within the pay period or as otherwise approved by the Employer.
(d) No employee shall be scheduled to work more than seven (7) consecutive days. This scheduling provision does not apply when employees mutually agree to exchange shifts or when an employee accepts or requests a shift at her own discretion.
(e) The Employer will endeavour to arrange shift schedules such that all employees will receive a minimum of one (1) weekend in every two (Saturday and Sunday2) off each month except November and December. Any employee not wishing to be scheduled for one
weekends off; however all employees will receive at least one (1) weekend off per month shall give notice in three (3). Work Schedule. (a) The following regulations shall govern the scheduling of hours for employees in the bargaining unit. Shift schedules shall be arranged so that:
(i) Employees are not to be scheduled to work more than seven (7) consecutive days.
(ii) Full-time employees shall receive a minimum of every third weekend off, and the employer will endeavour to schedule every other weekend off.
(iii) Employees working less than twenty-four (24) hours per week may be scheduled a maximum of two (2) out of three (3) weekends.
(iv) There shall be no split shifts, except for the Dietary Aide classification.
(b) Scheduling provisions do not apply when employees have the Employer’s approval to mutually agree to exchange shifts. Such shift exchange shall not result in any scheduling regulation violation and shall be at no extra cost to the Employer (and no change of status). Further, such scheduling regulations are not violated when an employee accepts or requests a shift at her own discretion which is outside of the work schedule. Should an employee want to give away a shift, the employee must have a written consent of her Manager prior to doing so. A shift giveaway shall post be at no extra cost to the Employer *and no change of status. During the changeover from Daylight Savings Time to Eastern Standard Time, or vice-versa, an employee shall be paid actual hours worked.
(c) Shift schedules covering a work schedule for minimum of four (4) weeks shall be posted a minimum of one (1) week period in advance in ink advance. Work Schedule. Each employee shall be scheduled to work a shift with regular starting and ending times. The Employer shall post determine, on an annual basis, the number of hours that each position in the bargaining unit shall work based on the formula of meals per employee/hour. In determining the formula of meals per employee/hour, ala carte and adult sales will be given a percentage determined by the USDA. This percentage changes each year and is based on the reimbursement amount allowed for free meals. The number of hours per position shall be reviewed by the Employer on an annual basis. No employee shall work schedule for a hours beyond his/her regularly scheduled amount of time without the prior consent of the Director of Food Services or his/her designee. The Employer reserves the right to refuse to process payment in the event that the employee does not obtain prior verbal or written approval. At the discretion of the Director of Finance and Operations one (1) week period day in-service may be scheduled during the school year.
