Workmen’s Compensation Act. The Contractor shall at all times indemnify the Employer against all claims for compensation under the provision of the Workmen's Compensation Act, 1923 (VIII of 1923) or any other law for the time being in force by or in respect of any workmen employedby the Contractor in carrying out the contract and against all costs and expenses incurred by the employer in connection therewith and (without prejudice to any other means of recovery) the employer shall be entitled to deduct from any money due or to become due to the Contractor (whether under this contract or any other contract) all moneys paid or payable by the Employer by way of compensation aforesaid or for costs or expenses in connection with any claim thereto and the Contractor shall abide by the decision of the Employer as to the sum payable by the Contract, under the provision of this clause.

Workmen’s Compensation Act. (1) All employees shall be provided with workmen’s compensation insurance coverage in accordance with the Workmen’s Compensation Act. (2) The Company shall pay full wages to any employee for the period of any incapacity arising out of occupational disease or industrial accident for which such employee is entitled to payment at reduced rates under the Workmen’s Compensation Act up to a maximum of 12 months commencing from the date that such employee first becomes entitled to payment under the Workmen’s Compensation Act.
Workmen’s Compensation Act. The CONTRACTOR shall comply with the State law known as the Workmen’s’ Compensation Act and shall pay into the State insurance fund the necessary premiums required by the Act. Workmen’s Compensation Act. Clause 37 :- The contractor shall be responsible for and shall pay compensation to his workmen payable under the Workmen’s Compensation Act. 1923 (VIII of 1923), ( herein after called the said Act) for injuries caused to the workmen’s. If such Compensation is payable and or paid by Government as principal under the subsection (1) of section 12 of the said Act on behalf of the contractor, this shall be recoverable by Government from the contractor under sub section (2) of the said section. Such compensation shall be recovered in the manner laid down in clause I above. Clause 37-A :- The contractor shall be responsible for and shall pay expenses of providing Medical aid to any workmen who may suffer a bodily injury as a result of an accident. If such expenses are incurred by Government the same shall be recoverable from the contractor forthwith and be deducted without prejudice to any other remedy of Government from any amount due or that may become due to the contractor Clause 37-B :- The contractor shall provide all necessary personal safety equipment and first-aid apparatus available for the use of the persons employed on the site and shall maintain the same in condition suitable for immediate use at any time and shall comply with the following regulation in connection therewith - a) The worker shall be required to use the equipment so provided by the contractor and the contractor shall take adequate steps to ensure proper use of the equipment by those concerned. b) When work is carried on in proximity to any place where there is no risk of drawing, all necessary equipments shall be provided and kept ready for use and all necessary steps shall be taken for the prompt rescue of any person in danger.

Notwithstanding the foregoing, Cyclerion shall assume worker’s compensation Liabilities to the extent they are imposed on Cyclerion under applicable Law or where the injury or illness related to the Liability is aggravated or subject to further injury after the Distribution Effective Time. A Liability which must be paid due to the existence of a deductible shall not be deemed to be covered by a workers compensation insurance policy for purposes of this Section 4.4. Subject to the foregoing, Cyclerion and each Cyclerion Group member shall also be solely responsible for all workers’ compensation Liabilities relating to, arising out of, or resulting from any claim incurred for a compensable injury sustained by a Cyclerion Employee that results from an accident or from an occupational disease which is incurred or becomes manifest, as the case may be, after the Distribution Effective Time. Ironwood, each Ironwood Group member, Cyclerion and each Cyclerion Group member shall cooperate with respect to processing of claims, any notification to appropriate governmental agencies of the disposition and the issuance of new, or the transfer of existing, workers’ compensation insurance policies and claims handling contracts.

  • Unemployment Compensation The Contractor shall be solely responsible for the unemployment compensation payments on behalf of their employees and personnel. The Contractor shall not be entitled to unemployment compensation in connection with the Services performed under this Agreement.
