Common use of Wrongful Dismissal Clause in Contracts

Wrongful Dismissal. Where an Arbitration Board finds that an employee has been dismissed, suspended or otherwise disciplined for other than proper cause, such Arbitration Board may: (a) direct the Employer to reinstate the employee and pay to the employee a sum equal to wages lost by reason of dismissal, suspension, or other discipline, or such lesser sum as, in the opinion of the Arbitration Board, is fair and reasonable; or (b) make such other order as it considers fair and reasonable, having regard to the terms of this Agreement. Wherever a stipulated time is mentioned herein, the said time may be extended by the mutual consent of the Union and the Employer.
