Your rights to end the contract. 9.1 Ending the contract because of something we have done or are going to do. If you are ending a contract for a reason set out below the contract will end immediately. The reasons are: (a) there is a risk that supply of the Services may be significantly delayed because of events outside our control; (b) you have a legal right to end the contract because of something we have done wrong; (c) you have the legal right to end the contract because of provisions in the Niche Agreement. 9.2 Exercising your right to change your mind (Consumer Contracts Regulations 2013). Where you are a consumer, or where you have applied for our Services online or away from our trade premises, you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail below. 9.3 How long do I have to change my mind? You have 14 days after the day that the Niche Agreement has been signed by both parties to change your mind. 9.4 How we will refund you. Where we are required to refund you, we will do so using bank transfer. However, we may make deductions from the amount. Deductions may include charges to cover costs incurred by us, for example, making of the niche cover, fitting of the niche cover and any other reasonable costs. 9.5 When your refund will be made. We will make any refund due to you as soon as possible. If you are exercising your right to change your mind then your refund will be made within 14 days of your telling us you have changed your mind provided you have supplied us with your bank details.

The reasons are: 9.2.1 we have told you about an upcoming change to the product or these Terms which you do not agree to; 9.2.2 we have told you about an error in the price or description of the product or service you have ordered and you do not wish to proceed; 9.2.3 there is a risk that supply of the products and/or services may be significantly delayed because of events outside our control; 9.2.4 we have suspended supply for technical reasons, or notify you we are going to suspend them for technical reasons, in each case for a period of more than 12 months; or 9.2.5 you have a legal right to end the contract because of something we have done wrong. 9.3 For most products and/or services bought online, over the telephone or away from our business premises, you have a legal right to change your mind within 14 days and receive a refund. These rights, under the Consumer Contracts Regulations 2013, are explained in more detail in these Terms. 9.4 Even if we are not at fault and you do not have a right to change your mind, you can still end the contract before it is completed, but you may have to pay us compensation. Your rights to end the contract. 26.1 Your rights to end the Agreement will depend on what has been purchased, whether there is anything wrong with it, how we are performing and when you decide to end the Agreement: 26.1.1 If any Equipment is faulty or misdescribed, you may have a legal right to end the Agreement (or to get the product repaired or replaced or the Service re-performed or to get a full or partial refund of money paid); see clause 30. 26.1.2 If you want to end the Agreement because of something we have done or intend to do, see clause 26.2; 26.1.3 If you have just changed your mind, see clause 26.3 and clause 26.6. You may be able to get a refund if you are within the cooling-off period, but this may be subject to deductions and you will have to pay the costs of return of any Equipment; 26.1.4 You have legal rights if we deliver any goods comprising part of the System late. If we miss the delivery deadline for any such goods, then you may treat the Agreement as at an end straight away if any of the following apply: (a) we have refused to deliver the goods; or (b) delivery within the delivery deadline was essential (taking into account all the relevant circumstances). If you do not wish to treat the Agreement as at an end straight away, or do not have the right to do so under this clause 26.1.4, you can give us a new deadline for delivery, which must be reasonable, and you can treat the Agreement as at an end if we do not meet the new deadline; and 26.1.5 In all other cases (if we are not at fault and you are not a Consumer exercising your right to change your mind) the provisions of clause 6 shall apply. 26.2 Ending the Agreement because of something we have done or are going to do. If you are ending the Agreement for a reason set out at clause 26.2.1 to 26.2.5 below, the Agreement will end immediately and we will refund you in full for any Fees which have been paid but where we have not yet provided the Equipment and/or Service paid for and you may also be entitled to compensation. Your rights to end the contract. (i) Ending before delivery and/or payment: You may contact us to end your contract for the Vehicle at any time before we have delivered it and you have paid for it, but in some circumstances we may charge you reasonable compensation for doing this, as described below. Your rights to end the contract. 8.1 Ending the contract because of something we have done or are going to do. If you are ending our contract for a reason set out at (a) to (b) below the contract will end immediately and you may also be entitled to compensation. The reasons are: (a) we have told you about an error in the price or description of the services you have ordered and you do not wish to proceed; or (b) you have a legal right to end the contract because of something we have done wrong. 8.2 Exercising your right to change your mind (Consumer Contracts Regulations 2013). (If we have carried out any repair services during the Protection Period then no refund will be given and you will have to pay us the full cost of the repair(s) (less any amount already paid by you to us) within 28 days of us requesting this in writing. This will be capped at the total annual plan fee (less any amount you have already paid to us). 8.4 If we have not carried out any repair services during the Protection Period and you have paid monthly or quarterly, there will be no refund due. If you have paid annually you will be charged a £10 administration fee.
