Zone Change and Subdivision. If the Town does not exercise its right to terminate this Agreement as allowed under Section 5, then the Town will, at its sole cost and expense, prepare a request to change the zone on the Historic Building Parcel from Central Commercial to Public Use. The Town will comply with applicable open meetings regulations in the consideration of the zone change. If the zone change is approved, the Town will prepare a subdivision plat application to create the new Historic Building Parcel. The newly created Historic Building Parcel will meet the standards of the Public Use Zone, with the exception of the setback from the from the newly created lot line to the Historic Building. The Town Council has authorized a reduction in the setback requirements from the newly created lot line between the Historic Building and the existing employee housing building on the remainder of the Best Western Property, in order to allow the Historic Building and the employee housing building to remain in their current locations. The boundaries of the Historic Building Parcel will be generally as shown in the concept drawing set forth on EXHIBIT A which was submitted to the Town Council in connection with its consideration of the development agreement proposal; provided that the final legal description of the Historic Building Parcel will be determined by a survey mutually approved by the Parties and prepared no later than the preparation of the subdivision plat contemplated by this Section 6. The cost of such survey shall be borne by Developer.

Contracting Of- ficer may agree to perform such structure maintenance under B4.218, if requested by Purchaser, subject to agreement on rates. Purchaser shall not be responsible for repair of such structures damaged by other National Forest users whose activities are not a part of Pur- chaser’s Operations.
