At least once every three years, the review shall include a replacement cost appraisal of all insurable Common Area Improvements without respect to depreciation.
If this Lease is not so terminated, then upon receipt of the insurance proceeds by Landlord (if insurance proceeds are available) and the issuance of all necessary governmental permits, Tenant shall promptly commence and diligently prosecute to completion the restoration of the Leased Premises or the Common Area improvements to the extent then allowed by Law, to substantially the same condition in which the Leased Premises or the Common Area Improvements were immediately prior to such damage.
