Construction Notes definition

Construction Notes means the promissory notes of the Borrower, substantially in the form of Exhibit B, evidencing Construction Loans.
Construction Notes means each Note issued as evidence of one or more Construction Loans.
Construction Notes means the promissory notes executed and delivered by BORROWER to each BANK substantially in the form of Exhibit A evidencing borrowings under the CONSTRUCTION LOAN up to an aggregate maximum amount of the lesser of (i) One Hundred Million and No/100 Dollars ($100,000,000.00), and (ii) sixty percent (60%) of the TOTAL PROJECT COST.

  • Amounts prepaid on the Construction Notes #2 may not be reborrowed.

  • Each required installment payment on the Construction Notes #2 shall be applied, when received in good funds, first to the unpaid interest accrued thereon and then to the principal balances thereof.

Construction Notes shall have the meaning given such term in Section 2.4(a) hereof.

"Note Purchase Agreement" shall mean that certain Note Purchase Agreement, dated as of August 1, 1994, by and between Lime SPV and PruPower, as said Agreement may be amended, modified or supplemented from time to time in accordance with the terms thereof and the terms of the other Transaction Documents. "Project" shall have the meaning set forth in Annex A to the Project Intercreditor Agreement. "Project Intercreditor Agreement" shall mean the Intercreditor Agreement, dated as of August 1, 1994, by and among Wilmington Trust Company, PruPower, the Collateral Agent, FAB, PNC, BAI and Prudential, as consented to and acknowledged by Lime and Lime SPV, as such Agreement may be amended, modified or supplemented from time to time in accordance with its terms. "Prudential" shall mean The Prudential Insurance Company of America, acting through Prudential Capital Group, and its successors and assigns. Construction Notes means, initially, the $15,000,000 Promissory Note attached hereto as Schedule "1.24", which promissory note will be replaced on the date of the initial Advance under the Construction Loan by promissory notes payable to each Bank in amounts based on each Bank's Pro Rata Share of $15,000,000.
