Corrective Action Work definition

Corrective Action Work means any and all activities of removal, response, investigation, testing, analysis, remediation taken to:
Corrective Action Work means the activities described in Section IV of Appendix 1.A (Groundwater Requirements) and/or other activities taken at the express direction of EPA pursuant to its legal authorities to address a release into the environment of (1) the following products, including intermediates and wastes: phosphoric acid, sulfuric acid, and FSA; (2) SACS, including entrained wastes and solids; (3) Process Wastewater, including mixtures and entrained wastes and solids; and (4) Phosphogypsum Stack System Wastewater, including mixtures and entrained wastes and solids. Corrective Action Work does not include other activities to be taken at the direction of EPA pursuant to its residual authorities to address other releases of hazardous waste and/or hazardous constituents that may affect human health and the environment, which directions and activities will be undertaken outside of, and will not be subject to, this Consent Decree;
Corrective Action Work has the meaning ascribed to it in Section 8.4(a).

Examples of Corrective Action Work in a sentence

  • Nothing in this Paragraph, however, shall affect Plaintiffs’ rights to determine and require necessary Corrective Action Work in accordance with Paragraphs 20 and 23 of this Consent Decree, or to restrict Non-CD Corrective Action that may be required at a Facility pursuant to Plaintiffs’ residual authorities under federal, state, and local laws.

  • Mosaic’s obligations to complete the Corrective Action Work are part of the Work required by this Consent Decree, but shall be set forth in and governed by an administrative agreement, permit, or order issued by FDEP under its authorized state program, and subject to EPA’s residual authorities under RCRA and Paragraphs 23 and 82 of this Consent Decree.

  • The United States and FDEP further retain all authority and reserve all rights to take any and all actions authorized by law to protect human health and the environment, including Corrective Action Work and Non-CD Corrective Action, and all legal and equitable remedies to address any imminent and substantial endangerment to the public health or welfare or the environment arising at, or posed by, Mosaic’s Facilities, whether related to the violations addressed in this Consent Decree or otherwise.


More Definitions of Corrective Action Work

Corrective Action Work has the meaning ascribed in Section 8.4(a)(vii). Cost of Reconstruction Work has the meaning ascribed in Section 9.9. CPA means a firm of certified public accountants authorized to practice in Florida selected from time to time by mutual agreement of the City and JoePC used by JoePC for any purpose specified in this Lease. Deed in Lieu of Foreclosure shall mean an instrument effecting a Transfer of all, but not less than all, of a Person’s interest in the leasehold created by this Lease in whole or partial satisfaction of a money obligation secured by a Leasehold Mortgage.
Corrective Action Work means 1) the activities described in Paragraphs 17 - 19 of Appendix 1, Attachment A; 2) the activities described in Section II.D of Appendix 1, Attachment B; and/or 3) other activities taken at the express direction of EPA or FDEP pursuant to their respective legal authorities to address a release of: a) the following products, including intermediates and wastes: phosphoric acid, sulfuric acid, and FSA; b) the following cleaning solutions, including entrained wastes and solids: SACS, PACS, and FSACS; c) Process Wastewater, including mixtures and entrained wastes and solids; d) Phosphogypsum Stack System Wastewater, including mixtures and entrained wastes and solids; e) BHT Effluent or GHT Effluent, including entrained wastes and solids when such releases occur: a) within AFIP, Upstream Operations, Downstream Operations, or the Process Wastewater RO Plants; b) from Mixed-Use, Grandfathered, or Recovery Units; or c) from the Phosphogypsum Stack System, as identified in a Facility’s Facility Report. Corrective Action Work does not include other activities to be taken at the direction of EPA or FDEP pursuant to their residual authorities to address other releases of hazardous waste and/or hazardous constituents that may affect human health and the environment, which directions and Table of Contents activities will be undertaken outside of, and will not be subject to, this Consent Decree (“Non-CD Corrective Action”);
Corrective Action Work has the meaning ascribed in Section 8.4(a)(viii). Cost of Reconstruction Work has the meaning ascribed in Section 9.9.

Related to Corrective Action Work

  • Corrective action means action taken to eliminate the cause of a potential or real non- conformity or other undesirable situation;

  • Corrective Action Plan has the meaning set forth in Section II.A.2.

  • Remedial Work has the meaning assigned such term in Section 8.10(a).

  • demolition work means a method to dismantle, wreck, break, pull down or knock down of a structure or part thereof by way of manual labour, machinery, or the use of explosives;

  • Remedial Action means all actions taken to (a) clean up, remove, remediate, contain, treat, monitor, assess, evaluate, or in any way address Hazardous Materials in the indoor or outdoor environment, (b) prevent or minimize a release or threatened release of Hazardous Materials so they do not migrate or endanger or threaten to endanger public health or welfare or the indoor or outdoor environment, (c) restore or reclaim natural resources or the environment, (d) perform any pre-remedial studies, investigations, or post-remedial operation and maintenance activities, or (e) conduct any other actions with respect to Hazardous Materials required by Environmental Laws.

  • Remedial investigation means a process to determine the nature and extent of a discharge of a contaminant at a site or a discharge of a contaminant that has migrated or is migrating from the site and the problems presented by a discharge, and may include data collected, site characterization, sampling, monitoring, and the gathering of any other sufficient and relevant information necessary to determine the necessity for remedial action and to support the evaluation of remedial actions if necessary;

  • Remedial Action Plan has the meaning provided in Section 3.9(c)(ii).

  • Remedial Actions means those actions taken in the event of a radioactive release or threatened release into the environment to prevent or minimize the radioactive release so that it does not migrate and cause significant danger to the present or future public health, safety, or welfare, or to the environment. Remedial action includes, but is not limited to, actions at the location of the release such as storage, confinement, perimeter protection which may include using dikes, trenches, and ditches, clay cover, neutralization, dredging or excavation, repair or replacement of leaking containers, collection of leachate and runoff, efforts to minimize the social and economic harm of processing, provision of alternative water supplies, and any required monitoring to assure that the actions taken are sufficient to protect the public health, safety, and welfare, and the environment.

  • Remediation Plan means a report identifying:

  • Administrative Action has the meaning set forth in paragraph 4(a) of Annex I.

  • Demolition works means any physical activity to tear down or break up a structure (or part thereof) or surface, or the like, and includes the loading of demolition waste and the unloading of plant or machinery.

  • Remediation Period has the meaning specified in Section 8.2(a);

  • Adverse employment action means an action that affects an em- ployee ’s compensation, promotion, transfer, work assignment, or performance evaluation, or any other employment action that would dissuade a reasonable employee from making or supporting a report of abuse or neglect under Family Code 261.101.

  • Urgent Work means any urgent measures which in the opinion of Engineer-in-charge become necessary during the progress of the work to obviate any risk of accident or failure or disruption of generation which become necessary for security.

  • Hazardous Materials Claims means any and all enforcement, clean up, removal or other governmental or regulatory actions or orders threatened, instituted or completed pursuant to any Hazardous Material Laws, together with all claims made or threatened by any third party against any portion of the Premises, Landlord or Tenant relating to damage, contribution, cost recovery compensation, loss or injury resulting from any Hazardous Materials.

  • Environmental emergency means any situation that has caused or may cause serious harm to human health or damage to the environment, irrespective of whether the potential for harm or damage is immediate or delayed;

  • Corrective Measure The contractor shall repair any deficiencies to meet the performance guideline within warranty period.

  • Remediation means any response, remedial, removal, or corrective action, any activity to cleanup, detoxify, decontaminate, contain or otherwise remediate any Hazardous Materials, Regulated Substances or USTs, any actions to prevent, cure or mitigate any Release, any action to comply with any Environmental Laws or with any permits issued pursuant thereto, any inspection, investigation, study, monitoring, assessment, audit, sampling and testing, laboratory or other analysis, or any evaluation relating to any Hazardous Materials, Regulated Substances or USTs.

  • Hazardous Materials Contamination means contamination (whether now existing or hereafter occurring) of the improvements, buildings, facilities, personalty, soil, groundwater, air or other elements on or of the relevant property by Hazardous Materials, or any derivatives thereof, or on or of any other property as a result of Hazardous Materials, or any derivatives thereof, generated on, emanating from or disposed of in connection with the relevant property.

  • Extra Work means any work which is determined by City to be necessary for the proper completion of the Project, but which the Parties did not reasonably anticipate would be necessary at the execution of this Agreement. Consultant shall not perform, nor be compensated for, Extra Work without written authorization from City’s Representative.

  • Environmental Complaint shall have the meaning set forth in Section 4.19(d) hereof.

  • health and safety specification means a site, activity or project specific document prepared by the client pertaining to all health and safety requirements related to construction work;

  • Affirmative action means action appropriate to overcome the effects of past or present practices, policies, or other barriers to equal employment opportunity.
