LDAR Program definition

LDAR Program or “LP” shall mean the Leak Detection and Repair Program provisions specified in Section VI of this Decree required to come into compliance with the requirements of 40 C.F.R. Part 60, Subparts KKK, VV, OOOO, and VVa, as well as any applicable state or local equipment leak requirements, and that additionally mitigate the alleged environmental harm allegedly caused by noncompliance at the Covered Process Units and Covered Types of Equipment (including “drill and tap” requirements in Paragraphs 29–31 and the “valve replacement and improvement” requirements in Paragraphs 33–42).
LDAR Program means the provisions set forth at Paragraphs 17 - 54 of this Decree, including measures required by 40 C.F.R. Part 61, Subpart V, 40 C.F.R. Part 63, Subpart FFFF, or any applicable state or local equipment leak requirements, and measures required to mitigate alleged environmental harm resulting from alleged noncompliance at the Covered Process Units and Covered Equipment (including “action levels” requirements in Paragraphs 23 and 24, “repair attempt for valves” requirement in Paragraph 27, “drill and tap” requirements in Paragraphs 28 - 30, and the “valve replacement and improvement” requirements in Paragraphs 32 - 42);
LDAR Program means the Leak Detection and Repair Program specified in Section V.B of this Consent Decree, which includes:

More Definitions of LDAR Program

LDAR Program means the Leak Detection and Repair requirements specified in SectionVI.B and Appendix A of this Decree. The LDAR Program requirements include measures required to resolve the Defendants’ alleged non- compliance with 40 C.F.R. Part 60, Subparts VV and GGG, and applicable corresponding state or local equipment leak requirements. The LDAR Program requirements also include measures to mitigate the alleged environmental harm caused by the Defendants’ alleged LDAR non-compliance at the Covered Process Units and Covered Equipment (including “initial attempt at repair” requirements in Paragraph 11 of Appendix A, “Drill and Tap Repair” requirements in Paragraph 14 of Appendix A, and the “Valve Replacement/Improvement Program” requirements in Paragraphs 18-22 of Appendix A);
LDAR Program means the Leak Detection and Repair Program specified in this Appendix A.
LDAR Program means a Leak Detection and Repair Program developed in accordance with the Canadian Council of Ministers of the Environment (CCME) document titled "Environmental Code of Practice for the Measurement and Control of Fugitive VOC Emissions from Equipment Leaks".
