Order Contract definition

Order Contract. - shall mean the Order/Contract issued, or a framework contract comprising of draw orders, including this annexure, Supplier's revised proposal and any other attachments or annexures thereto, by which the Purchaser purchases the Equipment from the Supplier.
Order Contract means and include the general conditions, bidding conditions, specific conditions, specifications, schedules, drawings, form of tender, covering letters, schedule of prices and quantities, letter of intent/ award of the Purchaser, “Integrity Pact (IP) (as and when applicable)”, any special conditions applicable to the particular Order/ Contract and subsequent amendments mutually agreed upon. It may also be referred as order or contract/ order or purchase order or contract.
Order Contract means and include the Purchase/ Work Order along with bid/ tender/ offer, the bidding conditions, clarifications issues by the buyer as regards the tender or the bidding conditions, covering letter, letter of intent / acceptance / award, specific agreement, the General Conditions of Contract and Special Conditions of Contract for commercial conditions of Purchase, specific agreement on technical conditions, special technical conditions and technical conditions/ specifications, Inspection/ Quality Plan, Schedule of Prices and Quantities, Drawings, if any enclosed or to be provided by the Buyer or his authorized nominee, Integrity pact (as and when if applicable), and any subsequent amendments hereto as may be mutually agreed upon, (It may also be referred to as the "Order"). Any conditions or terms stipulated by the bidder in the tender/offer or subsequent letters shall not form part of the Contract unless specifically accepted in writing by BHEL before award of the order. ‘Parties to the Contract’ shall mean the Seller and the Buyer as named in the main body of the Purchase Order.

Order Contract means a sales order, order form, purchase contract, purchase order, Add-on Contract, or other contractual instrument which conveys an agreement between the Parties for the purchase of one or more Subscriptions and/or other associated services and/or products from Nutrislice, which includes, incorporates, or references, by URL or otherwise, this Agreement or another document that includes, incorporates or references this Agreement. The parties agree that an Order Contract that binds the parties to this Agreement may be formed by any of the following: (i) execution of any of the foregoing contractual instruments by the Parties, (ii) issuance by Client of an authorized purchase order that attaches or references a sales order, quote, or proposal or other written instrument authorized by Nutrislice that incorporates or references (by URL or otherwise) this Agreement, or (iii) other written acceptance by Client of a proposed Order Contract, sales order, quote or proposal provided by Nutrislice. The term “Order Contract” shall collectively incorporate any subsequent addenda, renewals, amendments, and Add-on Contracts referencing an Order Contract.

Any conditions or terms stipulated by the bidder in the tender/offer or subsequent letters shall not form part of the Contract unless specifically accepted in writing by BHEL.
Order Contract as used herein means this written order acknowledgement. “Products” as used herein means any and all machine tools, machine tool parts, robotics components, tooling and related accessories, and other goods and equipment subject to this Order Contract and described on the cover page hereto. “Seller Products” as used herein means any and all Products sold by Seller to Buyer. “Services” as used herein means any and all configuration, design, modification, installation, assembly, connection, repair or other services subject to this Order Contract, including with respect to any Products not sold by Seller or already owned by Buyer, and described on the cover page hereto.
