PAGA Release definition

PAGA Release or “PAGA Released Claims” means the release by all Class
PAGA Release means any and all claims and/or causes of action for civil penalties and other relief available pursuant to PAGA against Released Parties that were or could have been pled based on any and all of the underlying alleged Labor Code violations pled in the Complaints and the LWDA notices. Regardless of whether any Class Members opt out of the Class Settlement, they will still be bound by the PAGA Release if they are members of the PAGA Settlement Group. The period of the PAGA Release will extend through the period that the PAGA Settlement Group members made deliveries to Amazon customers, on or about July 31, 2020, including any claims for penalties based on work performed during that period.
PAGA Release means any and all claims and/or causes of action for civil penalties and other relief available pursuant to PAGA against Released Parties that were or could have been pled based on any and all of the underlying alleged Labor Code violations pled in the original and amended Complaints and the LWDA notices. These alleged violations include, but are not limited to, violations of Labor Code §§ 201, 201.3, 202, 203, 204, 204b, 210, 216, 226, 226.3, 226.7, 247, 247.5, 432, 510, 512, 558, 558.1, 1174, 1182.12, 1194, 1197, 1197.1, 1198, 1198.5, 1454, 2800, and 2802. Regardless of whether any Class Members opt out of the Settlement, they will still be bound by the PAGA Release if they are members of the PAGA Group. The period of the PAGA Release will extend up to April 30, 2020.

Examples of PAGA Release in a sentence

  • All Aggrieved Employees, regardless of whether they have opted out of the Class Settlement as described above, and the State of California shall be bound by the PAGA Release and fully release and discharge Defendant and all Released Parties from all released PAGA claims upon the final approval of the settlement of PAGA Claims in this Action.

  • Because the settlement of PAGA claims in this Litigation is not a class action settlement subject to class action procedures, no Class Members can exclude themselves from being included in the settlement of PAGA claims and being subject to the PAGA Release if the court approves the PAGA Group Settlement.

  • Any Settlement Class Member who requests to be excluded from the Settlement Class will not be entitled to any recovery under the Settlement and will not be bound by the terms of the Settlement except the PAGA Release, and will not have any right to object to or appeal the settlement.

More Definitions of PAGA Release

PAGA Release means PAGA Employees will release and discharge the Released Parties from civil penalties under California Labor Code Private Attorneys General Act of 2004 as asserted in the operative complaint that arose during the PAGA Period premised on the facts, claims, causes of action or legal theories that were asserted in the operative complaintand disclosed in the LWDA letter including:
PAGA Release. All Class Members who are Aggrieved Employees (regardless of whether they are participating in the class action component of the Settlement) are deemed to release, on behalf of themselves and their respective former and present spouses, family members, representatives, agents, attorneys, heirs, administrators, successors, and assigns, the Released Parties from all claims for PAGA penalties that were alleged, or reasonably could have been alleged, based on the PAGA Period facts stated in the Operative Complaint and the PAGA Notice and ascertained in the course of the Action including, but not limited to, any claims for civil penalties based on Defendant’s alleged: (a) failure to pay minimum, straight-time, overtime, or double-time wages, and failure to pay other wages of any kind during employment; (b) failure to authorize and permit rest periods or pay rest period premiums; (c) failure to provide meal periods or pay meal period premiums; (d) failure to provide accurate and itemized wage statements; (e) failure to maintain accurate employment records; (f) and failure to reimburse or indemnify all necessary business expenses. This includes, but is not limited, claims for alleged violation of California Labor Code sections 204, 210, 226, 226.7, 510, 512, 1174(d), 1174.5, 1194, 1194.2, 1197, 1197.1, 1198, and 2802.
PAGA Release means any and all claims and/or causes of action for civil penalties and other relief available pursuant to PAGA against Released Parties that were or could have been pled based upon the allegations pled in the operative Complaint and the LWDA notices. Regardless of whether any Class Members opt out of the Class Settlement, they will still be bound by the PAGA Release if they are members of the PAGA Settlement Group.   • General Release has the meaning stated in Section 6.03.
