PAGA Released Claims definition

PAGA Released Claims means any and all Released Claims that arise under PAGA.
PAGA Released Claims means any and all claims for PAGA penalties that were alleged, or reasonably could have been alleged, based on the PAGA Period facts stated in the operative Complaint or in Plaintiffs’ notice of PAGA claim (the “PAGA Released Claims”).
PAGA Released Claims. All Non-Participating Class Members who are Aggrieved Employees are deemed to voluntarily release, on behalf of themselves and their respective former and present representatives, agents, attorneys, heirs, administrators, successors, and assigns, voluntarily waive, release and discharge any and all claims, obligations, rights, demands, liabilities, statutory causes of action, and theories of liability of every nature and description under the California Labor Code Private Attorneys General Act of 2004, Labor Code Sections 2698, et seq., whether known or unknown, arising from or relating to any and all acts, events and omissions occurring prior to the date of Preliminary Approval, that were alleged in the Complaint, First Amended Complaint, or PAGA Notices or could have been alleged based on any facts, transactions, events, policies, occurrences, acts, disclosures, statements, omissions, or failure to act pled in the Complaint, First Amended Complaint, or PAGA Notices, including, without limitation, (a) any and all claims involving any alleged failure to reimburse employees for personal protective equipment or other items alleged to be reasonably necessary business expenditures related to the COVID-19 pandemic; and/or (b) any and all claims 4855-3624-2235.3 involving an alleged failure to maintain safe working conditions during the COVID-19 pandemic, against Defendant or any of the Released Parties.

  • Class Counsel will also move the Court for an order of Final Approval (and associated entry of Judgment) releasing and barring any Released Claims of the Participating Class Members and the PAGA Released Claims of the Eligible Aggrieved Employees.

  • The release of the PAGA Released Claims is effective, regardless of whether the Eligible Aggrieved Employee submits a timely and valid request for exclusion.

PLEASE TAKE NOTICE: the Court of Appeals has held that all PAGA Members, regardless of whether or not he or she requests exclusion from the settlement, will release the released claims that arise under PAGA. See Xxxxxxxx v. Southern Counties Oil Co. (2020) 53 Cal.App.5th 476.
PAGA Released Claims means the release by Plaintiff Xxxx, State of California, and all Aggrieved Employees will release the Released Parties from any and all Labor Code violations identified, pleaded, or otherwise set out in or that could have been brought based on the facts alleged in Plaintiff Xxxx’x letter to the LWDA and/or the pleadings filed in the Lawsuit for the PAGA Period, including, but not limited to, claims for: (1) unpaid overtime; (2) unpaid meal and rest break premiums; (3) unpaid minimum wages; (4) penalties for non-compliant wage statements; (5) waiting time penalties; (6) failure to pay final wages in a timely manner; (7) unreimbursed business expenses; and (8) penalties under PAGA and/or any remedies available under Business & Professions Code section 17200.
PAGA Released Claims means all claims, demands, rights, liabilities, 4 obligations, penalties, attorneys’ fees and causes of action based on any and all PAGA claims 5 seeking civil penalties or any other relief under California Labor Code sections 558 and/or 2698 6 et seq. predicated on any alleged Labor Code violations that are alleged in, or could have been 7 alleged in, the operative Complaint by Xxxxxxxxx Employees based on the facts, events, policies, 8 occurrences, or acts alleged in the operative Complaint and/or based any alleged unlawful wage 9 deductions, failure to pay wages, cash bond or violations of the California Employee Bond Law, 10 untimely final or other pay, inaccurate itemized wage statements or records, failure to reimburse 11 or indemnify all necessary business expenses, or any California Labor Code violations alleged in 12 the Complaint (which include Labor Code sections 201-204.2, 221-224, 226, 400-410, 1174, 13 1174.5, 1198, 2802 and 2804) during the PAGA Period.
PAGA Released Claims means any and all Released Claims that arise under PAGA that are released by Plaintiff on behalf of the LWDA.
PAGA Released Claims means any and all claims asserted in the Action under PAGA, or that could have been asserted in the Action under PAGA based on the facts alleged, including but not limited to any and all claims for PAGA penalties for violations of the California Labor Code governing: failure to pay minimum wages, failure to pay overtime wages, failure to provide meal periods or compensate an additional hour of pay for missed or improper meal periods, failure to permit rest breaks or compensate an additional hour of pay for missed or improper rest periods, failure to provide accurate itemized wage statements, failure to pay all wages due upon separation of employment, failure to keep accurate and complete time and payroll records for employees, failure to timely pay wages during employment, failure to pay rest periods at the proper rate, failure to comply with Labor Code Section 226.2, and failure to reimburse necessary business expenses. PAGA Released Claims do not include any individual claims Aggrieved Employees may have.
