Plaintiff Releasees means Lead Plaintiffs, all other plaintiffs in the Action, Plaintiffs’ Counsel, and all other Settlement Class Members, as well as each of their respective current and former Officers, directors, agents, parents, affiliates, subsidiaries, successors, predecessors, assigns, assignees, employees, and attorneys, in their capacities as such.

• Dealership Settlement Class Releasors and CDK Releasors shall be permanently barred and enjoined from instituting, commencing, or prosecuting against the CDK Releasees and Plaintiff Releasees, respectively, any claims based in whole or in part on the Released Claims.

• Accordingly, Plaintiff Releasees and Defendant Releasees hereby expressly waive any and all rights and benefits respectively conferred upon them by the provisions of Section 1542 of the California Civil Code and all similar provisions of the statutory or common laws of any other State, Territory, or other jurisdiction.

Plaintiff Releasees means (i) Lead Plaintiff, its attorneys and all other Settlement Class Members; (ii) the current and former parents, officers, directors, affiliates, subsidiaries, successors, predecessors, assigns, assignees, and immediate family members of each of the foregoing in (i); and (iii) for each and every Person listed in part (i), their respective past, present, and future heirs, executors, administrators, predecessors, successors, assigns, employees, agents, affiliates, analysts, assignees, associates, attorneys, auditors, co-insurers, commercial bank lenders, consultants, controlling shareholders, directors, divisions, domestic partners, employers, experts, financial advisors, general or limited partners, general or limited partnerships, insurers, investigators, investment advisors, investment bankers, investment banks, joint ventures and joint venturers, managers, managing directors, marital communities, members, officers, parents, personal or legal representatives, principals, reinsurers, shareholders, spouses, subsidiaries (foreign or domestic), trustees, underwriters, and retained professionals, in their respective capacities as such.

Plaintiff Releasees means (i) Lead Plaintiff, his attorneys and all other Settlement Class Members; and (ii) the Immediate Family members, heirs, trusts, trustees, members, partners, including limited partners, shareholders, executors, estates, administrators, beneficiaries, agents, affiliates, insurers and reinsurers, predecessors, successors, assigns, advisors, corporate parents and subsidiaries of each of the Persons listed in (i), in their capacities as such.

Plaintiff Releasees shall have the meaning set forth in Section 3.3.
