Residential Limited Common Elements definition

Residential Limited Common Elements means and refers to the following: (a) the Swimming Pool Facilities and Amenity Deck Area, and the bathrooms on those levels serving those areas, and all the rooms, corridors, and other areas designated as Residential Limited Common Elements on Exhibit 2 attached hereto, (b) all storage areas within the Condominium Property, if any, except those storage areas specifically designated for or assigned at any time to a Commercial Unit, (c) all balconies and terraces appurtenant to Residential Units, (d) any mechanical or equipment rooms not serving a Commercial Unit and not designated in Section 2.10 as a Common Element; (e) all roofs, all roof structure, roof support elements and roofing insulation, (f) all elevator shafts, elevator cabs, elevator cables and/or systems and/or equipment used in the operation of the elevators traversing the Condominium, (g) all trash/recycling rooms and trash chutes on all levels except the first level, (h) the plumbing system, including without limitation, all pipes and other apparatus used in the delivery of the plumbing service serving more than one Unit (provided that if same shall serve only one Unit, the same shall be part of the Unit which it serves), except for grease traps serving only one Commercial Unit which shall be Limited Common Elements of the Commercial Unit they serve,
Residential Limited Common Elements means and refers to: (a) those elevators of the Building identified as "RLCE" on Exhibit “2", (b) all hallways of the Building located on Level Seven and above, as identified on Exhibit "2", (c) any mechanical rooms not serving the Commercial Units, (d) the recreational facilities and other Improvements located on Xxxxx 0, Xxxxx 00 and otherwise as identified as "RLCE" on Exhibit "2" and (e) any other portions of the Condominium Property identified as such on Exhibit "2" attached hereto. Residential Limited Common Elements means those Limited Common Elements which are for use of all of the Townhouse Unit Owners to the exclusion of the Retail and Commercial Unit Owner(s), as more specifically described in Paragraph 5 of the Master Deed and as shown on Exhibit C.

Examples of Residential Limited Common Elements in a sentence

  • The Residential Units, their undivided interest in the General Common Elements, the Residential Limited Common Elements and the Individual Limited Common Elements as set forth in Exhibits B and C to the Declaration shall comprise the “Residential Development” portion of the Project.

  • In accordance with the Oregon Tort Claims Act and the Oregon Constitution, CITY agrees to indemnify, defend, and hold harmless Managing Agency and its officers, agents, and employees against all liability, loss, and costs arising from actions, suits, claims, or demands for the acts or omissions of CITY and its officers, agents, and employees, in performance of this agreement.

  • The term “Residential Development” means that portion of the Project that comprises the Residential Units, the Residential Limited Common Elements, the Individual Limited Common Elements and the Potential Individual Limited Common Elements as set forth in the Declaration.

  • The rights to use the Residential Limited Common Elements appurtenant to the Residential Units as set forth in the Declaration.

  • When the context is not clearly expressed "Limited Common Elements" shall mean and refer to Residential Limited Common Elements, Townhouse Limited Common Elements, Commercial Limited Common Elements and Retail Limited Common Elements, all of which are defined herein.

  • Any repairs, maintenance or replacement costs with respect to the Residential Limited Common Elements shall be the responsibility of the Association.

  • A Residential Unit Owner may not make any alterations or modifications, including painting, to the exterior of the Residential Unit, or any part of the General or Residential Limited Common Elements, without the written consent of the Board of Managers.


More Definitions of Residential Limited Common Elements

Residential Limited Common Elements means those parts of the Common Elements which are limited common elements within the meaning of the Condominium Act and which are reserved for the exclusive use of, and are maintained at the exclusive cost of, all of the Residential Unit Owners according to their respective Residential Common Element Interests. The Residential Limited Common Elements are generally shown on the Plats and Plans, but shall also consist of any other portions of the Condominium which are intended to serve and benefit the Residential Units exclusively.
Residential Limited Common Elements means those portions of the Property (other than the Units, the General Common Elements and the Residential Common Elements), existing for the use and enjoyment of certain Residential Unit Owners to the exclusion of all other Unit Owners, as more particularly described in the Declaration and the Floor Plans.
Residential Limited Common Elements shall have the meaning given that term in Section 8.3.

Related to Residential Limited Common Elements

  • Limited common elements means a portion of the common elements reserved in the master deed for the exclusive use of less than all of the co-owners.

  • Limited common element means a portion of the common elements allocated by the declaration or by operation of section 38-33.3-202 (1) (b) or (1) (d) for the exclusive use of one or more units but fewer than all of the units.
