Target Customers definition

Target Customers as used in this Agreement, means the persons and entities to whom the Distributor is authorized to sell in the Territory, not including Reserved Customers, as said Target Customers are described in Exhibit C which is attached hereto and incorporated herein..
Target Customers means all of: (i) those customers or End User entities and/or customer or End User sectors or groups specified in the signature page to this Agreement executed by the Parties, but expressly excluding the Reserved Customers. Territory: means the geographic location(s), assigned by Arqit to Reseller where Reseller is authorized to Resell the Products, and/or the other criteria for defining the scope of the appointment granted in Section 2.1 below and as set forth on the signature page of this Agreement.
Target Customers and “Key Accounts” means those customers identified as such in the applicable Business Plan approved by Supplier; and “Territory” means that geographic territory described in Addendum C, as revised by Supplier from time to time upon notice to Distributor.

  • If a Target Customer elects to lease the Equipment, then upon Comdisco's receipt and approval of a Transaction Package for Leased Equipment, the purchase price for each unit of Equipment will equal the present value of the rental stream at an interest rate commensurate with the Target Customer's credit rating and prevailing market rates.

Nor shall anything in this Section restrict, or be construed to apply to, (i) sales, services (including the transportation of Gas) or the sale of products of the type provided at the time of execution of this Company Agreement, or mandated directly or indirectly by a regulatory body, including, but not limited to, the imputation of revenues, expenses or rate base, the effect of which is to create a penalty, economic or otherwise, for the failure to provide such sales, services or products, by PNG and NG in their respective certificated service territories, or AGL and Chattanooga Gas Company in their respective certificated service territories.
