Common use of SURPLUS MERCHANDISE Clause in Contracts

SURPLUS MERCHANDISE. Except for variations in quantities according to market practices, Goods in surplus of those specified in the Purchase Order will not be accepted, and Buyer shall have no responsibility to keep them. If requested by Supplier, Buyer may return the Goods at the risk and expense of the Supplier.
