00 Miscellaneous. 36.01 When available, the City shall furnish vehicles from the City’s car pool to conduct official City business. In the event a pool car is unavailable, the employee shall use the employee’s own vehicle on a temporary basis.
(a) An employee shall receive authorization from their Department Head or their designee prior to using the employee’s own vehicle.
(b) Temporary basis shall be defined as no more than five (5) consecutive working days unless otherwise agreed to by the employee. Employees who use their car on a temporary basis shall be reimbursed by the City at the rate established by the IRS.
(c) Any employee who drives their own vehicle on official City business must have a valid California driver’s license and proof of valid insurance.
36.02 The City recognizes that air-conditioned City-owned/leased vehicles can contribute to a comfortable and productive working environment. When ordering new vehicles, the City intends within reason to order air-conditioning in said vehicles when said equipment is offered by the manufacturer as an option.
00 Miscellaneous. The Contract shall inure to the benefit of and shall be binding upon the personal representatives and legal successors of the respective parties hereto. Nothing in the Contract shall inure to the benefit of any third party that is not a signatory, or a successor in interest to a signatory, to the Contract.
00 Miscellaneous. 10.01 These Contract Documents supersede all previous agreements between the University and the Contractor concerning this Work.
10.02 No action or failure to act by the University shall constitute a waiver of a right afforded it under these General Conditions, nor shall such action or failure to act constitute approval or acquiescence of a breach of these General Conditions, except as may be specifically agreed in writing.
10.03 The invalidity or unenforceability of any provision of these General Conditions shall not affect the validity or enforceability of any other provision. SUPPLEMENTARY GENERAL CONDITIONS OF CONSTRUCTION Facilities Planning & Management - Design & Construction Services Xxxxx State University SUPPLEMENTARY GENERAL CONDITIONS OF CONSTRUCTION (REVISED 7-2018) Where any article of the General Conditions of the Contract for Construction is supplemented in these Supplementary General Conditions, the original article shall remain in full force and effect and all supplementary provisions shall be considered as added thereto. Where any such article is modified, superseded or deleted here, provisions of such article not so specifically modified, superseded or deleted shall remain in full force and effect.
00 Miscellaneous. 13.01 Expropriation If at any time during the Term of this Lease, the whole or any part of the Building shall be acquired or condemned by expropriation, this Lease and the Term hereby granted may, at the option of the Landlord, be terminated and the Term and the estate hereby vested in the Tenant and any and all other rights of the Tenant hereunder shall thereupon immediately cease and expire and the Rent shall xxxxx and be apportioned to the date of termination. The Tenant shall forthwith pay to the Landlord the rent and all other amounts which may be due to the Landlord up to the date of termination and shall immediately surrender the Premises to the Landlord. The Tenant shall have no claim upon the Landlord for the value of the unexpired Term of this Lease. The parties shall each be entitled to separately advance their claims for compensation for the loss of their respective interests in the Premises and the parties shall each be entitled to receive and retain such compensation as may be awarded to each respectively. If an award of compensation made to the Landlord specifically includes an award for the Tenant, the Landlord will account therefor to the Tenant.
