Additional Data Requirements. In addition to the data specified elsewhere in this agreement to be delivered, the Contracting Officer may, at any time during agreement performance or within a period of 3 years after acceptance of all items to be delivered under this agreement, order any data first produced or specifically used in the performance of this agreement. Additional Data Requirements. Zillow will use commercially reasonable efforts to obtain and retain the necessary approvals from its vendors and licensors to permit Zillow to license to Yahoo and YRI, as Zillow Listings as set forth in Section 4.1, all of the Resale Homes and FSBO Homes listings on the Zillow Site(s) and any other Zillow Listings provided under this Agreement. i. To defend litigation brought against the government, including patent infringement, environmental and tort claims;
ii. To pursue litigation brought by the government against Grantee or one of Grantee‘s team members or subcontractors growing out of work performed under this Grant
iii. In the event the Government requires the information for investigations of fraud, mischarging, or similar charges against Recipient or one of its team members or subcontractors; or
iv. In the event of a catastrophic occurrence at the facility such as an explosion, accident or hazardous material release, where the Government requires the information to conduct an analysis of the occurrence.
X. XXX shall have the right to inspect the data listed above at any time.
D. By incorporating the data listed above into this provision, DOE makes no assertion as to whether or not said data would otherwise qualify as Limited Rights Data or Restricted Computer Software, as those terms are defined in this provision.

(ii) DOE shall be permitted to call for the delivery of the data listed in (i) above only in the following circumstances:

(a) In addition to the data (as defined in the Rights in Data - General clause included in this subcontract) specified elsewhere in this subcontract to be delivered, the Company may, at any time during subcontract performance or within a period of 3 years after acceptance of all items to be delivered under this subcontract, order any data first produced or specifically used in the performance of this subcontract.
(b) The Rights in Data - General clause included in this subcontract is applicable to all data ordered under this Additional Data Requirements clause. Nothing contained in this clause shall require the Seller to deliver any data the withholding of which is authorized by the Rights in Data - General clause of this subcontract, or data which are specifically identified in this subcontract as not subject to this clause.
